    Do NOT phone the creditor. You can, if you have not already done so, send AK the letter that you posted in post 801 above.
    I am NOT, nor do I profess to be, a Qualified Debt Adviser. I have made MANY mistakes and have OFTEN been the unwitting victim of the the shamefull tactics of the Financial Industry.
    If any of my experiences, or the knowledge that I have gained from those experiences, can help anyone who finds themselves in similar circumstances, then my experiences have not been in vain.

    Hi rog.

    I thought i would give you an update on what has happened with my CapQuest, Mackenzie Hall, Aktiv Kapital debts.

    Capquest sent me a letter last Wednesday saying it isn't Statute Barred because i have been paying, well i sent them another Statute Barred letter but this time i added the reasons why it is Statute Barred. Today, they sent me a letter saying they are going to investigate the complaint and the account is on hold. So a bit of a result there then. As it is defiantly Statute barred.

    Mackenzie Hall haven't as yet replied and they received the letter on the 11th of February so time yet, and Atkiv kapital are yet to respond. When/if they do i am going to totally ignore them morons.

  • I just got a letter from a company called Aktiv Kapital. I was in loads of debt years ago and due to a lot of personal problems they went unpaid. however this is 6 and a half years later and i live at a new address and have sorted myself out. I was really worried when i got this letter and emailed them straight away saying i wanted to sort out payment agreements. Then I realised i didnt know what the outstanding balance was actuallly for so i emailed them again asking.
    Can anyone help me did i do the right thing??? I heard there is a 6 year statute on debts. I know it was wrong to not pay them but i was a different person then and i now have a young daughter to look after and i am worried about this very much......what should or can i do

    It is called the Statute of Limitations becaus ethe LAW states that it is unfair for a creditor to chase a debtor after 6 years, not some silly whim on your part. The courts and the OFT agree.

    one day after the 6 year limit the debt IS STATUTE BARRED AND REMAINS STATUTE BAREED FOR ever.(sorry capslock on). So if it is 6 and a half years, even thoguh you sent an e-mail, the debt is stuill not enforceable in the courts and it is still solely at your discretion as to whether you pay.

    Please bear in mind that AK probaly paid peanuts (literally pennies in the pound) for a whole load of debt, knowing that f they get one or two people per hundred to pay, they can make a profit.

    Personally, if you recompensed them for the cost of buying the debt fairy stuff, but paying the book value on a debt for which they paid next to nothing is unfair.

  • hi Ras...thanks for your speedy reply. i dont know how they got hold of me i live in a different country now. Like itold them i am a single parent on benefit so if i have broken the statute by the email. will they have to settle for what i can pay them. I dont want to relapse to 6 years ago lol

    god i was so worried all day..i know i was wrong to leave the country in debt....but i have never made the same mistake again.
