    Hi Sutton111,

    What happened after you confronted the dca about the statute
    barring being confirmed by the NDL?
    Did they have a go at you? or did they let it go?

    Well I told them about it and they got very "upset"!!! They started saying "oh it stays on your file forever" which is a lie. In the end they put the phone down on me because they knew i was telling the truth. I've sent a Statute Bar letter off to them today as well.:)

    On another note I have been make payments to CapQuest and Connaught Collections since May last year because they threat earned to make me bankrupt!!! so i just started to make payments because I was scared.:(

    Anyway i contacted NDL about Mackenzie Hall and they told me the two debts to Capquest and Connaught are statute barred and not to pay anymore money!! So I'm not going to.

    I wasn't sure because I started replaying the debt I thought it wasn't Statute Barred but this wasn't the case it is. Because it's more than Six years between default and me making payment. :)

    You sound as if you've had as much the same luck as me!
    I feel a bit more confident about this now. (Thanks to everyone )
    I to had a run in with capquest who took me to court over £920
    obtained a Scottish decree and took out an inhibition on my house
    I have since found out this debt was statute barred before it
    was taken to court in May 2007, I could have used this fact as a
    defence which should have had the case dismissed.
    I will be taking steps on Monday to see if I have a chance of
    overturning these 2 judgements.
    Sutton please be wary of capquest they can be really aggresive
    I am proof of that.

    I would always advise you not to phone any dca.
    I was also wondering what reaction you got off capquest and connaught
    if you phoned them?

    I've been read your previous posts with great interest!!

    I find they can be difficult to deal with but I feel I have my fact correct now and I will use them to my advantage.

    I have sent them a Statute Barred letter off yesterday recorded delivery. I have made them aware of this.

    They told me to keep paying while they look into it but they can f**k off.

    I probably would of felt gulity but to tell someone they are going to make them Bankrupt and have no legal right to this is disgusting.

    I'm not to bothered about ringing them to be honset. The reaction was interesting, I explained why I am going to send them it and they said you seem to know your legal position and that was about it.

    Well I have had a reponse from Connaught Collections this morning. Very Quick.:)

    It says "We write to inform you that we have closed our file and informed our client 1st credit Limited who are the assignees of the debt"

    They have asked me to send all future correspondence in relation to this matter be forwarded directly to 1st Credit their client.

    Well I take it they know the debt is Statute Barred and can't do anything.

    What makes me laugh is they told me they owned the debt not 1st Credit!!!

    Further to my last post about Aktiv,

    I sent them the letter which was a CCA requst and a £1 postal order to cover the cost.
    They have finally sent a reply to me today which looks like of one there stand letters see below

    Further to your recent correspondence in connection with the above ref matter

    in order to assist us in investigation and resolving the issues you have raised, we would ask that you contact our customer relations on the above free phone number.

    the purpose of the conversation woudl be to ascertain certain important facts in relation to this matter which will assist us in complying with your request and or resolving your enq.

    we look forward to hearing from you in connection with this matter.

    End of letter
    They have sent no CCA forms nor sent back my £1 :( lol

    What I would like to know is what do I need to send to them now, in reply. as reading posts form here the last thing I should do is call them.

    If someone would be kind enough to reply this would be great.
