  • i wrote to these clowns dated 13/06/08 asking for the proof of an alleged debt i have with them, of which i know nothing, i have just recieved something photocopied with my initial and surname of which i cannot recollect, and a ticked box stating they look forward to receiving my proposals for payment,dated 31/07/08!!

    Now this i'm sure is outside their legal 12+30 days to send the requested info and my letter stated, a signed true copy (so a photocopy doesn't count does it?) and no signed true copy of deed of assignment. I just want to make sure my information is correct before I consider my next move if anything!

    Help much appreciated!

    What does this 'photocopy' actually say, pp?

    Check that, first, then double check the date of your first letter. If one month and 14 days have elapsed (which they probably have) then send them the 12+2+30 day letter that you will find in the following link:

    In both cases there are template letters that you can use.

    Thank you Rog2 and anyone else that helped out with our problem with Thames Credit we sent a statute barred letter and today we received a letter back from Thames credit saying "the account is now closed and we should receive no further contact from them":T We would off never have known about this without you guys thank you again!!!!!:beer:

    Quick google search suggests that these people are in fact "Debt Managers", who are debt collectors. Often involved with Aktiv Kapital, which you have obviously guessed since you have posted on this thread.

    They are fishing for info.

    There is no guarantee that you are even the person they are looking for with these people.

    Would it be tempting fate to mention that I've still not heard anything after they threatened to send their agents round 3 weeks ago? :silenced: :shhh:

    I was contacted by AK in June 2005 regarding a dept from feb 2000. After some bullying tactics I ruluctantly agreed to pay of the dept. In September 2007 I wrote to them and said that I was stopping payments until they could provide a copy of the original credit agreement. I was originally under the impression that the original dept was settled by my employer as part of a severance agreement. This turned out not to be the case.However I was worried that I may be taken to court and reluctantly mayed payments. I wrote to them after reading that in order to enforce the dept they would have to provide a copy of the original credit agreement. Chancing my arm I also requested repayment of the £5k that I had already paid ( this was mostly intrest on the original amount of around £2k). I had no correspondance from them until a few weeks ago when they started phoning and requesting payment.
    My quetion is this
    As I made payments does this put me in a weak position?
    Should I stick to my guns and continue to ask for a copy of the original agreement?

    Interestingly enough on of their opperators let slip that they wouldn't take court action to enforce this but would continue to persue me by phone and letter.

    ( they no longer have my address only a work phone number)

    Not at all, lm. In fact, if AK are unable to provide you with a true copy of the original executed cca, within the prescribed legal time frame, then you are legally entitled to request that ALL monies, paid by you, are refunded.

    Should I stick to my guns and continue to ask for a copy of the original agreement?

    Yes - of course.

    Interestingly enough on of their opperators let slip that they wouldn't take court action to enforce this but would continue to persue me by phone and letter.

    That IS interesting - possibly they already realise that they are on a 'sticky wicket'. :think: :think:

  • I have too, have recently received a letter from Debt Managers Limited of Edinburgh who are acting on behalf of Aktiv Kapital. They claim I owe £469.00 from the 8th April 1998!!!!! I called to query the amount and the debt and they told me it was from an electrical store, but they have an address that I have never lived at. The took me through no Data Protection questions at all and gave me all the address details of the property that I have no knowledge of, a clear breach of Data Protection rules as I understand it. I have now sent a letter accepting no knowledge of the debt and also stating that as the debt is now ten years old they cannot claim it back even if I did know what the debt was.
