well its taking 6months but....

i have finally today heard my DLA has been reinstated

thats 6months of letters, a drs visit, 2 hearings and lord knows how much clerical time and expense

considering my diagnosis is a degenerative one u wouldnt of thought they would say it was better and have stopped it in the first place

course thats also 6months i have had to struggle, pay my car tax and generally go without treatments that would have helped

still goes to prove if u persevere it can be turned around

i know i dont post much on this section but i do read it so a big thanks to all the advice on this board without which i would probably have given up

    thanks.. well it took some doing after my dr said i had a full range movement (like he wouldknow!!!) but the dr that they sent round was very helpful and even added things to my claim that i hadnt even thought of

    anyone else going thru this process dont give up

    Glad you were successful. I obviously haven't seen your case but they don't just take DLA away. There would have been a GP or consultant's report that would have said that you could now do the things that previously you couldn't. As one of the other posters has said their GP gave totally incorrect information and the DWP doctor was actually very helpful (they usually are if you are genuine). For anyone else in this position the best (and quickest) way to get things put right is to ring up and ask for the decision to be looked at again (DO NOT say "I want to appeal" as then it goes to appeal which can take months and involves a tribunal), ask for copies of all the evidence used to make the decision and tell them that you will be sending in further evidence and not to look at the decision again until they receive it. Once you have the evidence it may be obvious what went wrong i.e. your GP has said that you can walk 3 miles without stopping whereas in fact you can only do 10 yards. If this is the case, take the offending report to your GP and get them to correct it. If you can't see what the problem is then go to the Citizens Advice Bureau - they will have at least one staff member trained in the various benefits laws (might be an idea to ring first). He or she will be able to see why the decision was made and will know what information needs to be gathered to counteract the duff info. If you are genuinely entitled then a 'review' is 99% successful (unless of course you get an idiot Decision Maker but they tend to have stopped being idiots by the time they are allowed to do reviews). Don't go to your MP (often takes longer to get a decision because the MPs all write to the wrong place!) or any type of benefit advice place that charges (the CAB are free).

    Official figures give the success rate of revisions as about 10% whereas appeals are successful in 50 - 60% of cases. Asking for review can mean a long delay before a decision and then it can be another long delay before an appeal is heard if the revision is not successful.

    it actually was cos of my GP's report (theres an old post about it somewhere) who said i had full range of movement.. how the hell he would know as he hadnt seen me about my back for years i dont know and the last time i saw him i was collapsed in his surgery!!! (another matter)

    i did ask for a review and asked them to write to my consultant but they didnt wait for that information and held the hearing anyways which is when they then sent the Doctor to my house who completely supported me and then held another hearing where they reinstated my DLA as it was... this all took over 6 months

    funny enough when i made my initial application i was refused but was awarded after the review but this still took almost 5months to go through

    i now have to get my car re-registered and hopefully will be able to claim back the car tax i paid but i have stil been without the money all this time and paid for things i neednt have cos i didnt have my award eg.. the dartford tunnel toll

    aah well at least it worked in the end
