Was i missold this morgage??

    You signed the form and presumably saw the info included, or are you now saying that you signed a blank form.

    It is very frustrating when someone is loaned money that they should never have had because of a dodgy salesman and these cases should be dealt with, But you did say in your first post that you were aware that inflated figues were used to obtain the mortgage and therefore you appear to have been involved with the fraudulent application even if you did not write the figures in personally

    I didnt have to proof my income, the broker put down i earned more at the time without me knowing. I do earn that much now cos of my job but at the time i didnt, it got me into the !!!! basically. The mortgage was transfered to my currant lender on completion so why did i have to pay early redemption charges??? I paid £795 for competion also. The solicitor lied in court the second time i went. The mortgage company dont want to help, all they see is money. I pay £55 more a month then i should do under the court order cos i want to but they recalculated my account last week and say i owe £360 under the court order, i have to pay this on the 23rd of this month, last week i was told i was up todate, everyweek ive been upto date.

    At the end of the day i signed for it, i made a big mistake, i have 6 months left before i can re mortgage, i wont get any early charges then, i want to start afresh no arrears etc. My main concern is the arrears not the brokers. How a mortgage company got a solicitor to lie in court.

    At the end of the day, im not a mortgage adviser, i know nothing about advising, if an adviser comes to your house advises you to do that, how the hell do i know!!!! I wont be the first person, plenty of people just like me been advised like this.

    I doubt if you'll be able to remortgage with another bank/BS as you say you fell into arrears straight away. I'm not sure how relevant it is that the solicitor stated that one payment hadn't been credited when you think it had, as the fact remains that you've been unable to afford the mortgage from the beginning. You wouldn't be in a stronger position to remortgage if the solicitor hadn't stated what you feel is a lie.

    Isn't it better to try to move on, get the £2000 paid back, and then attempt to get your credit rating sorted out rather than trying to blame other people?

    I often attend court with clients and the solicitors acting for the mortgage companys only get their cases a day or so before the hearing as they are often only agents. They do not have time to check all the info they have received and have to go on the instructions they have been given which is not always as up to date as it could be.

    Good luck with the re mortgage hope you choose a reputable mortgage advisor this time, there are a lot of good ones about, unfortunately the one bad one reflects on everybody in the industry which is not fair.

    When a child at school gives an excuse for wrongdoing to a teacher as "so and so told me to do it" the teacher will say "if so and so tells you to jump off a cliff would you do it"?

    You may have been wrongly told to do it but you still went ahead and did it knowing it was wrong.

    You accuse everyone of telling lies, including a solicitor in court. Your accusations against the broker are almost certainly going to be your word against his. The complaint would come down to a balance of probabilities and based on your comments so far, you dont come across as being very credible.

    What makes you think you will be able to remortgage? you are in arrears, you have been to court and you clearly cannot afford the monthly repayments. You are not an attractive lending proposition.

    Rather than trying to blame others you should take responsbility for your own actions. I suggest you pop onto the debt free wannabee section of the board and see if the very nice people in there can help you find a way to manage your debt better.

    True but presumably you know right from wrong and to lie on an application form even if you are advised to do so is obviously wrong.

    Cos theres brokers out there like the one i mentioned just to get yer cash, and dodgy mortgage places, my credit rating without the mortgage is fine, i know it isnt now.
    Id rather sell and make money than rather go to a broker.
