Maybe im thinking along the wrong lines but wont the DPS have 2 deposits held for the one property? Surely they can see there is no grounds for holding yours and give it back. Hopefully sooner than later!Norn Iron club member - 2650 -

Going to save what everyone has written her, thanks everyone, and read it with hubby and parents later. Tried calling DPS but they have a problem with their phones at the moment, typical!

Well I phoned the DPS and asked to file a dispute. They told me I must wait 14 days from when I first requested the money (tuesday gone) then I could file for a single claim and take action against him.
I didnt contact him at all after the morning conversation. He phoned me at 5pm, and pointed out that even though it was 1am in another country he was going to sort this out and by tuesday we would have our money (or at least it will be released from the DPS, might take 3 days to transfer). He was very very nasty, arrogant, didnt listen to a word I said, was patronising, claimed he could charge us loads of money for numerous things but obviously wouldnt elaborate on what, seeing as he has no inventory and hasnt been in the property himself. He said he simply wants to see the back of us forever and thats why hes giving the money back. He said he knows the tenancy laws inside out and I know nothing at all about anything...
I came off the phone and cried. I have never ever been shouted at and spoken to to horribly in all my life and if the money was only £100 I wouldve told him where to shove it, but as its a lot more than that and we really need it I just had to sit and hold my tongue like a complete idiot.
I'll update again when/if the money comes through. Thanks again for the advice. Im guessing he spent the day checking things out and realised I was right about a lot of things and without him having proof of supposed 'damages' he hasnt a leg to stand on. I also pointed out that when the roof was fixed 3 months ago his very own builders checked the guttering and it was all clear!

You weren't the idiot - he was. You have been in the right all along, and you've probably caused him more grief than he's caused you, simply because you haven't given in to him. SMILE! The playground bully has got his comeuppance, and nothing that he could do or say has been able to persuade you that he's anything other than wrong.
If he does call you again, don't respond to his questions or comments, because he's not going to suddenly see the light, no matter what you say. Simply keep control of the conversation by saying what you want to get, ignore his irrlevant rants, and keep pulling him back to the relevant things that matter to you.I can spell - but I can't type0 -
When you safely get your deposit back, print off all the emails between you and the LL and send them off to his new tenants. They are going to need advance warning of what to expect.0
