Some advice please

Last friday I decided to purchase an iPod, won the auction paid the money straight away. Included in the auction was pretty expensive delivery charge for next day special delivery.
There was a comment saying they would only post Monday to Friday which I accepted however the seller has just emailed me saying that he has still not sent the item and so I will not get it now until Friday at the earliest and as it's being sent to my work will not get it until next week as my work finishes at 12pm.
Can I try and claim back some of the postage costs as this is anything but a next day service. I've never had to leave a neg before but am starting to get seriously peeved off about this.
Has anyone else had experience like this?

well the seller has 7 days to post regardless of service used
unless they state get it fast

Basically need to distinguish between delivery times and dispatch times, seller has 7 days to dispatch by whatever means paid for. the special delivery next day only kicks in from when item is posted, and then its at royal mails disposal! Basically sellers use special delivery because of the trackability and the insurance against scams, it is paypal and ebay themselves that make this a necessary precaution for sellers of high value items.
Seller cannot control that if you wish to use special delivery the way ebay make it look is that you get the item next day after paying. unless auction specifically states that item will be posted next day then the seller has complied with the rules.

hiya! Deffo read thread linked above (i was the OP lol!!) - all i would say is check the postage on package when u receive it as it turned out that i paid for next day delivery when seller actually posted it using 1st class so he is now gonna send a refund of £4.50 (well hopefully.....!) as i paid for a more expensive service than i received! But from what everyone has said, it would appear that basically seller has 7 days to send it regardless of what postage method they use (apart from when it says get it quick or fast or something lol) .........i agree that it IS misleading tho(maybe sellers should put something on listing so people are AWARE?), as next day delivery sounds like u will be getting it pretty sharpish; ie not much point paying loads extra if they arent gonna send it for 7 days!!!Baldrick, does it have to be this way? Our valued friendship ending with me cutting you up into strips and telling the prince that you walked over a very sharp cattle grid in an extremely heavy hat?0

I've had a read through the other thread and agree that Next Day Delivery as a postage option is very misleading.
I wasn't aware of the 7 days rule but will keep that in mind. I guess I'm just not happy that I received 3 emails asking for payment in the space of 5 minutes (granted these may have been automated) which was done, went into work on Monday alerted the office a parcel would be getting delivered soon but the seller couldn't even be bothered telling me himself instead waited until I contacted him on the Tuesday, told me he would post it next day, has since failed to do so, promised it would be sent today but I have heard nothing from the seller yet.
I've asked twice that they send me the SD number which has never been mentioned by them. and now if it doesn't arrive in the morning I will be waiting until Tuesday to get it as my work is closed until then (Moving out my flat 2morrow so had no choice about where to get it sent).
I've not had this experience buying aything on ebay before and just feel annoyed about it

Ok so to update,
The iPod arrived on Friday (Finally) postage cost £5.05 (Not the £9.99 I paid) and to top it off the auction said there would be a protective leather case (That the iPod basically lived in) which the seller has now said he owns up that he can't find it and to let him know if there is anything he can do :mad: .
I've replied to him and basically asked for the delivery costs back so as I can get my own case sorted out but have not heard back yet.
What would you guys do here?0 -
Could I respectfully remind you that you paid £9.99 for postage & packing (also referred to as shipping and handling) - I guess the £5.05 you mention is only the price of the postage paid to Royal Mail which is only a proportion of the cost. (quite a common misunderstanding). Furthermore, you were aware of the cost stated when you bid. If you didn't like the cost stated, you shouldn't have bid. What if the postage had cost the seller say £25.00 courier service, would you have been happy to pay an additional £19.95 over the agreed price? I know I wouldn't have!
With regards the lack of leather case, I would suggest the item is significantly not as described. Your options would be to either negotiate a mutually agreeable partial refund so that you keep the iPod, or you return the iPod at your cost and receive a full refund.
Your request for a refund of postage has probably antagonised the seller, but the seller seems equally at fault. If that had been me selling the iPod and I couldn't find a leather case stated as included, I would have gone down to Poundland and bought a leather case so that the buyer had no cause for complaint."Now to trolling as a concept. .... I guess the only issue is that there is no leather case. See how much a BIN would cost, say on ebay - let the seller know and either ask them to refund this amount or to purchase and send one to you themselves. A similar thing happened when I bought a digital camera that came without its memory card. Start a dispute (item not as described) if the seller ignores you.0
