bankrupt last week need a liittle help please

hi
went bankrupt last Friday ,spoke to OF today and they want my car.which is what i need help with.she said i can appeal which i want to and is what i need help with..the reason i need my car is that i have Rheumatoid Arthritis.the car is only worth about £450 but it is my life line.because of medication i am on i have to have blood tests every 12 weeks,i have a occupational therapist which i have seen every week for the last month.i am waiting for a physiotherapy appointment to help me with my walking and a walking stick i can hold etc etc.the dwp have recomened me to shaw trust on wmp (work management program) run by doctors to manage pain at work etc.i could not go shopping with out my car.she said none of the above matter but no car would cause serve hardship and detrimental to health as i couldn't get to hospital or shops to buy food or get prescriptions .so can any give advice on the way forward please.
also my lecky/gas are saying the will take my meter out and wont give me a pre payment unless i pay my arrears weekly they wont accept the bankruptcy has wiped the slate clean how do i swap suppliers (souther electric at the mo) and get a pre pay meter in my situation.

Hmm! that seems a really harsh descion from the OR. Will go find a link to help with writing your letter to get the car exempted.
Here we go. You need to prove that the car is a necessity rather than a convienience. So letters from your healthcare professionals will probably help.

If you have not had your interview yet you still have time to fight your corner. No sorry that seemed a bit quick that's all.They have been known to change their minds!. Had she had chance to look at all the bumf you sent back to them or your I&E yet?..You could appeal as seems very harsh for a £450 car. You could also try writing a letter explaining things to her. Hi snakehips11 i think your list above is more than enough to get the car treated as exempt in my opinian. not at the moment but i have recently applied for dla. i had no help or support since my illness began 4yrs ago.ill be nice and say i slipped through the system. i am now trying to sort my life out.0

Thats a shame as although it wouldnt make it so it would guarentee the exemption it would help you appeal.
What you need is to get a letter from your doctor stating the car is a must for you due to your health issues and also demonstrate it wouldnt be cheaper to use alternative means of transport, so find out how much it would cost in taxis to do everything you HAVE to use the car for now, if it works out more then the OR cannot argue that a car is a nescesaty not a luxurary so will have no choice but to treat it as an exempt assettThats it, i am done, Blind-as-a-Bat has left the forum, for good this time, there is no way I can recover this account, as the password was random, and not recorded, and the email used no longer exits, nor can be recovered to recover the account, goodbye all ………….0 -
Hi Snakehips
Tell the OR what the utility providers are saying. They CANNOT make you repay any arrears at the date of BR, it would in fact be illegal for you to do so. I'm not certain they can force you to have a card meter and I wouldn't trust them not to 'load' it so you pay a higher rate and end up paying the arrears anyway, the swines that they are. Have a look at www.uswitch.com (I think) to see about changing suppliers.

I also have Rheumatoid Arthritis and my car was also registered as disabled for getting my father around. The car was worth about 250 at the most but my OR still wanted it, in the end she let me buy it back for 20. I couldn't beleive it because I was under the impression they had to be worth more than 2000 for them to show any interest in it. A bit of advice too, they wanted more for it and I haggled with them until she said well is 20 ok and I just said yes.0

Its not just the value of the car its the assosciated costs they look at too cazjenki. If you tot up the running costs of a car per year it can sometimes free up a lot of income allowing them to produce a surplus income high enough to get an IPA.
Then there are also the liabilaty issues as technicaly the OR becomes responsible for the vehicle the miniute your declared BR.
It still stinks how they sometimes use those excuses and egnore the issues behind the claim of need in one instance yet dont seem to care in another and class it as exempt just like that.
