What a pickle. Proper directions.
Multi-track = costs awards so you have to go extremely careful at this point. Frankly, I would be extremely tempted to discontinue before their costs increase and you would be liable to pay their costs on a discontinuance.
If you do decide to proceed, and you have the stomach and deep pockets for it, then you MUST consider ADR. Invite them to mediation although I am afraid that this is likely to still cost each of the parties a large sum of money.
I think discontinuance now is the best approach.0
