I have now sent a polite email to the seller explaining why I want a full refund. I have also sent the set back to him via recorded delivery, after taking photos. I am now some £14 out of pocket with nothing to show for it. At the moment looks like I'll get half of that back, but I am hoping the seller will see my point of view once he gets the package.
Ho-hum, now we wait for signs of life...
How poor am I, getting upset over a few quid. I really should get a better job...

Thanks for starting this thread - it's raised my awareness about buying goods which may be incomplete... how on earth can one prove that it was incomplete when received...

Need more advice!
After all that last week, having sent back the lego recorded back to the seller on tuesday, and having no reply from him - I started a PayPal chargeback. Then I got an irate email from the seller how can I go to PayPal without sending him the lego?
This morning the postie delivered the lego BACK TO ME, because it had been REFUSED at the sellers end.
I'm really confused now. What do I do next. I wrote to the seller explaining the situation politely - saying how I'm not prepared to send it again for almost £3 when it was refused.
I just got a reply from him *QUOTE If your Paypal claim is awarded before I get the Lego back I will be forced to check my legal standing on this matter as it seems I'm going to end up losing out. UNQUOTE*
I really don't know where I stand now.
Can you add to your PayPal statement? Will they contact me for further info? Is Ebay gonna get involved? He said he'd contacted them. I'm going to get suspended or something aren't I?

Bloody hell I bet you wish you'd never laid eyes on that lego set! When you said that the post office returned the lego to you because it was 'refused' at his end, do you have this documented anywhere, ie on a returns label or something as proof? If you have proof that he refused delivery when you tried to return it then I doubt he has a leg to stand on. Try writing to Ebay and seeing if they can advise you. Poor you!! *hugs*0

this is sounding like a real nightmare. However. ebay won't suspend you, in fact they will probably ignore the seller as they rarely get involved in such disputes. So don't worry about that.
I don't think you can add to your paypal statement, you will have to wait to see what the seller reply says.

He must be getting ticked off though!
Should I now wait to see what PayPal say or try posting it again (no point doing that if he refuses it - but if PayPal pay up, I obviously can't keep the Lego), or talk to the seller (am I making things worse) ?

If they tell you to post it back to him keep the 'sticker' packaging yourself (as intact as you can). However I think Paypal might ask you to send it to them (Paypal) at some point.

Yep, by refusing to accept delivery he's trying to get you to give up as he knows you're now another £3 out of pocket. Don't send it back to him UNTIL PayPal tell you to, which will be when they award you the chargeback.

As Malestrom says above the whole purpose of refusing the package was in the hope that you get bored and dont want to lose anymore money on this and just give up. Him refusing it also indicates that he knows he is in the wrong and just taking you for a fool.
Let Paypal get you your money back and then let him check his legal standing, i can just see him dragging you through court for some lego, he sounds a bit of a !!!!!! to be honest0
