son has been awarded IB at long last but can he get IS backdated for the QP also.

Success at last.Just found out that after 5 months of sheer hell with the benefits agency my son has at long last been awarded IB from 22nd March.
He applied 5 months ago buy it was all on hold because he was too young for IB.They said his qualiofying period under the youth rules was 1st sept 07 -21nd march 08 and the claim for IB was only payable from 22nd March.
What I want to know is can he get any IS for the period during which his IB claim was in limbo. He has a qualifying period of 6 months for IB under the youth rules ,I think that means that he would have got IB if he had been old enough and has to claim IS for that same period now.
Please advise me on this as its something that even the woman I just spoke to on the phone from IS doesnt have a clue about.
It just doesnt seem right that son can have no money for a 5 month period even though they had medical evidence, just because he was too young for the benefit he was told to apply for.

The IBY 196days/28weeks Qualifying Period is just that.

To be entitled to IBY from day 197, the first 196 must be served first and IBY is not payable during the QP.

If the IS claim was made at the same time as the IBY claim 5 months ago, then, IS would normally have been payable from then until the IBY claim was put into payment.

I am assuming that JCP were holding sick notes for the whole QP.
Contact JCP and ask about the IS claim prior to the IBY award.
