Frederickson International-CCA advice please!

    I am worried that I might've got myself in a pickle cancelling the direct debit even though Frederickson are now in default. What exactly can frederickson int'l do now? can anyone advise me..am now quite worried I've screwed this up

    You haven't screwed up, but the CCA request is not a silver bullet.

    After 12+2 working days when they are LEGALLY obliged to send a valid copy of the CCA by, the debt is unenforcable - without a court order.
    They would need to go to court, prove the debt was yours (by producing a copy of the CCA) and explain to the judge why they did not produce it when you requested it.

    Did they send back the £1 postal order you sent?
    (You did send the £1 payment didn't you?)

    hi george,yes I did send £1 postal order with the first 12+2 letter...I have checked the royal mail website and the letter was signed for and they haven't sent the postal order back

    YOU GOT NO WORRIES, they should remember their obligations below

    * Should you fail to comply with this request in any part, or exceed the prescribed time allowed to respond, you shall be in default of this act and legal request.
    * Whilst you are in default, and until such time as you fully comply, -you may not pursue, enforce or increase any alleged indebtedness, nor disclose any information regarding me to any third party what-so-ever.
    * If you fail to fully comply with this act and request for 12 working days plus one calendar month, you will have committed an offence under the act.

    thankyou setmefree for your advice...I really appreciate it as all the stress of my mountain of debt/dca's chasing me/never having any money to pay any of my creditors is really really getting me down at the moment :(

    no frederickson sent a stern letter demanding payment for the outstanding debt and then...nothing.no cca or any further correspondence at all. hope this helps!

  • In summer 2006 Whilst paying off a debt (Argos) with Moorecroft, I was contacted by fredricksons to say I would receive a CCJ if I didn't pay off the debt immediately. I was extremely upset and sat down at work with my boss to discuss it, she then called them on my behalf.
    Whilst on speakerphone we were advised to pay within 2 weeks and that it didn't matter whether this was to them or Moorecroft. I chose to pay Fredrickson and did so in two instalments. I was advised that I should contact Moorecroft to inform them of this. I wrote immediately to them and was told that Frederickson International would deal with the court and I would definitely not receive a CCJ!
    I have since found out that I have had a CCJ since 2006 and have been in turmoil - this is ruining my life. I have written to fredrickson and the court on two occasions and received nothing in return. My Boss is a witness to tho whole proceedings as she is the one who actually spoke to them. I have sent photocopies of my bank statements twice proving this was paid. It was only a couple of hundred pounds and my life is in ruins.

    Moneymeltdown, I got a couple of letters then nothing. But be warned, a few months later they sold it on to another DCA.

    Velvetjacket, I'm not sure of the answer to your question, maybe if you started a new thread about it you'd get more views and answers?

    i have a debt with these people (fredrickson) i wrote for cca 9 months ago, and got nothing,
    i am just sitting and waiting as i expect they wil lsell it on for pennies as they have not got a cca.
    then my letters will have to start all over again the the new debt collection agency
