Frederickson International-CCA advice please!

I have been paying £200 per month for the last 4-ish years to Frederickson Int'l who are the DCA for an old RBS (now MINT) CC I had.I have almost paid off the full amount to them.But.... can I request a CCA from them even though I made this repayment agreement verbally? Has anyone here claimed money already paid to dca's back?

Frederickson even called a while ago to see if I wanted to increase my payments so the debt would be paid off quicker! They are vile!

I have only just found out about cca's and requested one today from Lowell (also vile!)

    Yes it is your legal right to request your CCA unless it was for an overdraft, they are partially exempt, you cannot claim the money back from a dca unless you are claiming that the debt is not yours and have mis paid them, if they dont have a CCA it means they cannot not enforce payment in a court of law, not that the debt does not exist, which is why you cant get them to remove it from you credit file even if they have no CCA(well its very hard put it that way)

    I've just sent a cca off to them, I think the 12+2 is up next week and I've not heard anything from them yet.
    Unless I say otherwise 'you' means the general you not you specifically.
  • if only i'd known about requesting a cca from them years ago...grrr! anyway i'll keep going with the lowell one instead...thanks for your advice guys!

    I would just keep up payments to FRED , how much is left to pay ? But getting the CCA FROM lowell is a good move .

    So theres still £1200 to pay . In that case I would CCA request them to . If they have not got one , could save you £1200.

    Thats completely up to you , I would wait and if they do not respond within the 12 +2 days , I would not pay any more till they comply . But you have to be sure of what that could result in .
  • I believe you can cancel your payment instruction once the DCA fails to respond with a CCA in 12+2 time frame.

    However you don't state the date that the DD goes out.

    If you send the CCA request today by recorded / special delivery and then start counting forward 12+2 days. Should the next DD payment be longer than that date I would cancel, as if in the slight possibility (very slight) they produce a correctly prescribed CCA with all the right terms you could then just sign another another DD.

    The reason all these DCAs mention to increase your payments is not to pay off your debt quicker, but that the DCAs are starting to realise that by every day an increase number of people are becoming aware of the right to see the correct documentation and prove the DCA has a legal right to collect any money.

    Do it today, start counting, then sit back and wait. The date will pass, no CCA will be produced (or will be incorrectly prescribed) and you have saved paying these low lifes another £1200.

  • thanks again for all advice...much appreciated everyone...my monthly DD to frederickson goes out on 23rd of each month so i've just paid april's...I am sending cca letter today...12+2 will be up before the next payment i think??
