Trouble with Seller

Hi all,
My Mums BF recently bought a mobile phone from Ebay on my account, the phone only came to £10.50 inc p+p.
The phone arrived quickly, in a jiffy bag wrapped in white tissue paper.
Opened the parcel to discover there was a large chunk missing from the top left corner of the phone, and a crack next to it. These weren't listed on the listing otherwise wouldn't of bought it.
Contacted seller via Ebay messenger asking for a refund, seller said no as I didn't get postage insurance, so would have to take it up with Royal Mail as there was no damage to the phone before postage.
The missing chunk wasn't inside the tissue paper, which would of been if it was damaged in postage, as the tissue paper and jiffy bag weren't damaged. So the piece must of been missing before it was put into the paper and the jiffy or else it would of surely been inside the paper as it was selotaped very well and difficult to get into lol.
I opened a dispute with PayPal for item not as described, the seller offered me a £5 refund saying they had not refused a refund on Ebay messenger (which they deffinatly had!) I refused the refund as I believe a full refund is in order as the item is damaged. Mums BF will happily post back trackable method at his own expense, but Seller isn't interested.
Escalated the claim for PayPal to decide the outcome.
Surely I am doing the right thing? Just need a bit of back-up as I wasn't sure whether to accept the £5 refund

Im with you 100%. Keep to your guns I reckon hes hoping you back down. Surely it is his responsibility to contact Royal Mail if HIS parcel was damaged in transit (which goes against his no insurance answer) !! Keep us informed0

Can't see the crack or the chunk missing on the picture at all0 -
the listing just said used in working order.
i am not sure how you will get on with item not as described because if the phone is used and works fine then it could be said that it was as described0 -

But when I contacted the seller about it, they were arguing that it must of been damaged during postage as it wasnt damaged before, but it must of been, the missing part wasnt in the paper wrapping, where else could it be? Will just have to wait for PayPal to sort it out, as its out of either of our hands now0 -
stick to your claim and keep all emails you have had with the seller, they should have said in the listing if it had a crack and chunk missing, I would wait for paypal to sort.0

Well, after over a month, PayPal decided we should send the phone back to get a refund, that's fine, sent it special delivery and it got there the next day, PayPal emailed to say we would be getting a full refund, we would have to wait up to 5days to get this.
Then seller leaves an unpaid item reminder with Ebay? Surely he can't do this as its a refund?0 -

reply to stating that you have already paid and give the paypal transaction id for the payment.0 -
you can speak to someone at paypal, it at the bottom left corner, you do have to go through a lengthy automated bit first, but stick to your guns.
Paypal freeze the sellers paypal account while the dispute is going on. If they have agreed you can have a full refund, you will get it. They pay you and then pursue the seller for all the money or take it out.
You can post the messages you have had with the seller to paypal it really helps, and they can check they are genuine somehow as well.
I would leave feedback saying it wasnt fit for sale as soon as you get your money back.
