Non-refundable deposit

Hello all,

About 3 weeks ago, I went to view a new build house through a local estate agents and having liked it I put a £1000 non refundable holding fee with the estate agent to secure the house for me. However, having viewed it recently, I noticed that the builder put a pipe through the wall on the outside of the house so that the fireplace can be hooked up to a gas bottle on the outside. I was told nothing about this by my estate agent and if I knew that this was going to happen I would not have giving the holding fee. I have now totally changed my mind about the house and I'm looking for my £1000 back from the estate agent regardless of what they now do with the house I just want my money back.

Do I have a case to get my £1000 back as a change was made to the house after I put down this deposit an was not informed at all about it? My reasoning being that I put the £1000 down on the house as I first viewed it and would not have put £1000 down if I had known that they were going to drive a pipe through the wall.

Any advice appreciated.
