CCA - moral implications

I am in the process of setting my DMP with the CCCS.
After reading the many emails on this forum (thank you all) i am thinking about asking for my CCA's of my debtors!
Now, maybe I am just being weak but I know I ran up that debt myself and have no problems in paying them back while they except my payment amounts.
What I need to know from everyone who are apply, for what reason are you trying to get your debts put aside? Especially if you know that you ran these debts up yourself?
I am not trying to get anyone to justify their way of thinking, but I am just wondering if I am just being too soft about this whole process!
Any words of wisdom would be appreciated..either for or against CCA's
Thanks Susanna

Sussanna,
I think you might be misunderstanding our reasons for requesting a CCA. Personally my debts were run up and although I've had to go onto a DMP paying reduced payments for an awful long time to settle them I DO want to pay them back. I've recently sent off a number of CCA requests mainly to DCA's who have tried to bully me into paying higher payments than I am able.
My desired outcome from these requests is that a legal and therefore enforceable CCA is not forthcoming so when I'm threatened with court action I can tell them to sod off.
Once again I will still maintain the reduced payments to these people.0 -
Thats the answer in a nutshell !Sussanna,

These debt collection agents use threatening phone calls at all times of the day and night . Please list the morals they employ !0

Thank you for your replies! As I said I am not getting at you personally at all I am in awe how you have handled everything! Maybe what I should have ask is " Could sometime persuade me to go down the CCA route, as I feel like I am going to chicken out because I know I am totally responsible for my debt?"
Shinyhead! I think you have the answer my question!
Once again thank you!0 -
The way I see it you should challenge these debts even if you know you ran them up. These organisations are there for one reason, to make money out of you.
There are plenty of people who are scared into paying debts that they do not owe and have not had the credit. The way I see it when somebody who does owe money gets away with it it balances it out.
I dont think these DCA's have such ethics as you....
Dont think of it personally, if you can get away with it dont pay. Would your bank pay you if you couldnt prove you had money in account with them?0 -
in my case i sent off request for cca, not to get out of paying anything , but because i had tried to negotiate with the original creditor a reduced payment and was bullied into agreeing to a larger amount than what i could genuinely afford, i tried to explain my circumstances, and i even stated i was trying to be responsible, but still this ignorant man would not listen,
i ended up crying after i put down the phone because i felt intimidated and bullied, i am normally a strong person, but he made me feel very weak, i then decided that if they wouldnt listen to me on the phone, perhaps a cca request might do it, and if it goes in front of a judge i have proof that at least i have tried to sort it, yes i ran up the debt myself i admit that, but anyone can fall on hard times, and there is no shame in it, although these people make you feel like you should be ashamed.0 -
It’s a headache for the DCA’s when requesting a CCA
therefore, give them what they give us
If there is no CCA available, it becomes an even bigger headache for the DCA
so go for it.
I’ve NO loyalty to ANY DCA, and remember, its war out there
its all part of the process. Click here for Martins (MSE) advice on who to contact with Debt Issues - YOU HAVE NO REASON TO USE A FEE PAYING DEBT MANAGEMENT COMPANY- THEY CANNOT DO ANYMORE FOR YOU THAN THOSE LISTED IN MY LINK ABOVE.

I'm with shinyhead on this one. I have requested CCA's from a couple of my larger creditors but have not bothered with the smaller ones (as most of my smaller ones are less than 1.5k so I'm thinking that it would probably cost those creditors more to take me to court). I don't really want to go through court action but I am paying via my dmp and have every intention of continuing along this route in order to clear my debts.Debt 30k in 2008.:o Cleared all my debt in 2013 and loving being debt free
Mortgage free since 2014
