TAX Problem

Well this is my first post on MSE so appologies if this is in the incorrect section. Basically I need some help with a recent problem my girlfriend has had with her tax. Il start by explaining the senario:


I was wondering if you could help. I'm writing on behalf of my girlfriend who is having troubles regarding tax from her previous employer. We recently moved cities as I took on a new job and my girlfriend took on the first available part time job she could find until she found something more suitable. Before moving with me and taking on her new job my girlfriend had two part time jobs and a split tax code one was 416L and the other was 106T. When she started her new job she handed both P45 forms to her employer. After the first month when she was paid she was paid using the 106T tax code but was assured that this would be sorted come the next pay day. Between the two pay days my girlfriend found a more suitable job and handed in her notice. She worked her notice and left to start her new job. When the pay date for her old job came round she did not get any pay and she didn't receive any pay slip. She phoned the company to enquire as to why this has happened and they told her that it must be a payroll issue. When she asked for the number for payroll the firm declined to give her the number and said they would investigate it. They phoned back the same day and told her that she had in fact been paid 471 pounds but had then paid 467 in tax and 4 pounds national insurance. After allot of being passed pillar to post we finally go the number for payroll who could not provide us with any information as to why this had happened and could not tell us where the pay slip had disappeared to. We decided then to call the tax office who said they had no record of my girlfriend actually working for this company. So as a result my girlfriend was out of pocket a whole months wage and has had to survive off me until she gets paid from her new job at the end of the month. Any advice anyone could give us would be greatly appreciated and helpful.

    Its hard to advise without seeing the P45's and paylsip. Has she kept the P45 part 1a from the two jobs in your previous city? Has she still got the payslip from the fist payday at the new job? Has she got a P45 from the new job - if not, she certainly needs to ring them and ask for it.
    I am guessing all this happened in the last tax year. I think the easiest way to sort it out would be to take the P45's from the 2 previous jobs, her payslip from the new job and her P45 form the new job to the tax office and ask them to look into it. It sounds as if the new employer is a bit rubbish, but without seeing the figures its hard to be more helpful.

    Go back to them (company rather than payroll) and ask them to re-issue pay slip and ask for a P45.

    When she left the company in question they said her p45 would be sent out with the payslip. But of course no payslip came and hence no p45. So when she started her newest job recently she had to fill in a p46? I think thats what it was. The new companys finance department have told her not to worry they have sorted her slip tax codes to a normal 533l tax code and that what the previous company had done is against the law as they cannot tax more than 50%? im not familiar with this so i cannot confirm that. Do you think the best course of action woudl be direct with the company(who we havent had much luck with) or the tax office?

    Go to the tax office. Only they can sort out last year's tax anyway, so they will deal with your OH's tax as well as sorting out a rubbish employer.

  • All employers have a legal obligation to issue employees with an itemised payslip, and a P45 upon leaving. If you don't get one soon, suggest that HMRC might be interested in investigating their PAYE practices, that'll hurry them up no end.
