    National Debtline have the suggested letter below available on their website.

    It basically tells them to "bog off" until they provide any proof that you owe the debt.

    The references to the OFT guidelines are correct and the threats about reporting them if they continue to chase the debt are real.

    You have contacted us regarding the account with the above reference number, which you claim is owed by ourselves.

    We would point out that we have no knowledge of any such debt being owed to The Loan Company.

    We are familiar with the ‘Office of Fair Trading Debt Collection Guidance’ which states that it is unfair to send demands for payment to an individual when it is uncertain that they are the debtor in question.

    We would also point out that the OFT say under the Guidance that it is unfair to pursue third parties for payment when they are not liable. In not ceasing collection activity whilst investigating a reasonably queried or disputed debt you are using deceptive/and or unfair methods.

    Furthermore, ignoring and/or disregarding claims that debts have been settled or are disputed and continuing to make unjustified demands for payment amounts to physical/psychological harassment.

    We would ask that no further contact be made concerning the above accounts unless you can provide evidence as to our liability for the debt in question.

    We await your written confirmation that this matter is now closed. Otherwise we will have no option but to make a complaint to the trading standards department and consider informing the OFT of your actions.

    Thanks very much for that fermi, really appreciate it. I'm going to have a think as I hand over the keys to the landlord tomorrow (for the address they send letters to) so I probably won't be able to receive a reponse (not sure I'd want to give them the new address, I'll give them the courtesy to check the electoral roll and send another special letter to this place, lol).

    So can I have a default to my name if I don't contact them? I read that even if you prove your innocence, it is a huge effort to have this removed.

    While they are "fishing" I think they are unlikely to register a default.

    If they do, then page 19 onwards of this publication by the Information Commissioner's Office describes how to dispute any false information that they might record.

  • Hi,
    I had a letter from this company stating that I owed money. I couldn't actually remember if I did or not (had a lot of debts in the past), when I phoned them they said I had bought a bed on credit x amount of years ago and that I owed them money. Well I knew that I hadn't bought any bed on credit- it's not something you buy everyday is it? So she told me the dates I had supposedly bought this bed, which were over 6 years old anyway. So I rang the National Debtline & sent the above letter, I did have a letter from them (AK) saying they were 'investigating further' but haven't heard anything since. They are bullies!

    The impression I get of them is that they buy old debts from companies (who may have written them off) and by using intimidation and fear, get some money from some people. I just can't believe it's legal! I actually wanted them to come to the house just so they'd waste a journey.
