AKTIV KAPITAL getting hold of my details?

Hello, I had a letter today off Aktiv Kapital, telling me that they conduct intensive data matching using British Telecoms OSIS databse and the electoral roll, they state that one or both of these information resources had confirmed we lived where we live.

Then they go on about a debt that is outstanding,

What I want to ask is are they or any of the companies they got our information from in the wrong for supplying them with our details?

Any help, really greatfully received.

    well I think the electoral roll is a public document and anyone can view it and isn't the bt osis database the phone book??

    I dont know if it is the phone book, but I am supposed to be ex directory?

    I found this by playing with google:

    BT OSIS is a central database managed by British Telecommunications which contains telephone numbers from all of the UK’s main Telecom's providers – for example BT, Kingston Communications, Cable & Wireless, NTL and numerous other cable companies.

    OSIS is updated daily and includes DQR Numbers and Ex-Directory information.


    It sounds like its a super central phone book. and apparently 3rd parties can search it.

    In saying that Aktiv Kapita seem tobe gits who specialise in trying to collect statued barred debt.

    If you want give us a little more details on the debt they are chasing and we will help you draft and appropriate bofof letter if you want. Do not call them under any circumstances

    They are saying I owe a balance of £1153.16 and that this amount needs repaying, they reckn they have offered me various incentives?? to repay it and that I need to set up a payment plan with them.

    Firstly how old is the debt?? Is it infact yours?? if it is when did you last make a payment towards it?

    First of all Thankyou for taking the time to help me.

    I really am not sure, we thought we were all clear with everything we had owed out and have not heard anything of anyone requesting money from us, and then this came out of the blue.

    As far as we are aware we dont owe anything.

    Ak specialise in buying old debts that are no longer enforceable in law, or will shortly be unenforceable.

    Based on what we encounter here it is not at all unusual for them to advise people that they have failed to respond to previous non-existant communications and the always demand the full amount.

    The first thing is that this may not be your debt - you may just have the same name as someone who owes money. Secondly, even if it is, there is a good chance that it is very old and would not be enforceable through the courts.

    The object of the exercise as far as AK are concerned is to panic you into paying the whole lot before you have had a chance to check the legal situation, or even if you owe the money.

    So do not call them, ever, as they will bully you.

    And at this stage, do not respond at all. The onus is on them to prove you owe them money not the other way round.

    Good afternoon all

    Excellent site by the way and very informative.

    Hope you can help with this; I'm replying in this thread as it's very relevant to me. I've recently moved home however still had a lease on another flat which was vacated. I went to clean the flat before the handover to the landlord and noticed three letters from AK all demanding money for a debt (Comet). I've received this a while back and am sure I contacted them.

    My father who lives at another address also received this letter. The link? we both have the same initial and surname BUT neither of us have purchased from this store and both of us have thankfully not had these types of problem in the past.

    Now my concern is what to do? I'm not too far off considering a mortgage and am concerned this will place a CCJ or defualt on my unblemished credit history. Reading about this company gives me the impression they are a law unto themselves and it's going to be a long arduous process!

    On one hand I don't feel that I should have to prove who I am, as it was their choice to abuse the information they could obtain (surely there's a law against guessing who a debtor is and then harrassing them??). However on the other hand I don't want to tarnish my credit history.

    Please advise.

    Thanks for the advice. However can they not take legal proceedings as they threaten? I'm really considering calling them tomorrow (begrudgingly) as I really don't want defaults.

    As mentioned, I've moved home so I anticipate another similar letter from them in the near future (once they figure out there's someone with this name on the new address!). I'd like something written by them (like an apology letter) as I feel I may need it in the future. I really cannot believe there is no law stopping these companies harrassing people based on an assumption. I wish my name was John Smith, that would cost them a bit...
