I need your advice Re:Van i bought

I need your advice on this guys and girls. I bought a van about three weeks ago. This was bought from an Car online auction house that I have been registered with for years now. All vehicles are sold as seen and they are either Vat qualifying or not so depending where they come from they would add VAt at the end of the sale or not.

So they had advertised this van as non Vat qualifying vehicle, so i bid for it and won the auction. They sent me an invoice which i signed for and they charged my account the right amount.
A week later they delivered the van and they send the paperwork through the post. Everything fine.

Almost two weeks after that i received an email saying:can you ring us re: van you bought from us. So i called them yesterday to be told that they had missold the van with no vat and would i be prepared to pay for their mistake??

As much as i felt for whoever made the mistake i said no as i am not a trader so i have no way of recovering another £500 on top of sale price. Had i known this i would not have bought the vehicle or i would not have bid for it as much. They had a week to rectify the problem before they delivered the van anyway. Beside the issue becomes a bit more complicated when i bought the vehicle for a charity event hence there is no way i can go back and ask for more money.

Anyway the women i spoke to, almost put the phone down on me but what really put me off was that from today they have closed my account with them. Oh why?? frown.gif

So what do i do? your advice is appreciated.

    It's their mistake so it's their problem and IMO, they should dip into their pockets.

    You've got paperwork showing what the bill was and that you've paid it. Let em fight for it. If it goes to court, I'm sure a judge would tell them it was their mistake and their problem.

    Cheers, but have they got the right to just close my account with no explanation given to why?
    Isn't this like being banned from shopping at tesco's just because they got their pricing wrong?

    probably in the terms and conditions that they can close the account if they want....like how how shops have the sign that they can refuse custom

    When this type of confusion arises at say, British Car Auctions, or Manheim, USUALLY they would have the vehicle re-invoiced, but to show the VAT within the actual sale price, as the tax would need to be paid/declared regardles of the purchasers VAT status.

    However, for account customers, there have been plenty of times when the VAT gets invoiced at a later date & we pay up!!

    Regarding the account closure, as mentioned already, this is at their discretion.

    Think you need to have a chat with a senior staff member at the auction house, before you loose the chance to make more purchases.

    & you mention it being a charity purchase. It might well be worth their while talking to the VAT office locally & seeing how they can claim back this VAT, as well as any charged to them for other expenditure - it is quite likley that they can!!
