can i claim child care element ?

Hi all
Im not working currently claiming incapacity benifit hubby is self employed we have 1 child 14 months old ,
Now i may not be right but someone told me i can claim childcare for her i was thinking of putting her into a nursery 2hrs twice a week to help her meet other kids and socialise a little i was going to jst pay for this but can i calim help with it ?

No you both need to be both working and claiming working tax credits0

Thats not right - if one parent in a 2 parent claim is working & the other is incapacitated you can claim childcare costs. Whether you get any money will depend on your household income.0

Jay is correct. Make sure if you call to advise TCO of childcare costs that you are Incapacitated for childcare purposes.0

From the link it states -You are treated as incapacitated if you receive one of the following
• Disability Living Allowance
• Attendance Allowance
• Severe Disablement Allowance
• Incapacity Benefit at the short-term higher rate or long-term rate
• Industrial Injuries Disablement Benefit (with Constant Attendance Allowance for you)
• War Disablement Pension (with Constant Attendance Allowance for you)
• Council Tax Benefit or Housing Benefit with a Disability Premium or Higher Pensioner Premium for you, or
• a vehicle under the Invalid Vehicle Scheme.0 -
