whilst my landlord is to contribute to this financially. When I was buying the flat and saw the provided documents I believed that that's how it was going to be and therefore considered the property suitable for me and worthy the asking price I paid for it.
What interest do you have? Are you landlord, tenant or owner? You seem to be all three in this thread.
If you now own the property and the deeds state no parking, then if the other owner is reneging on his bit, then simply do not contribute financially, as per your part.
If you are a tenant, then either get onto your landlord, or if it really bugs you that much, move!0 -
It just seems you are demanding alot.. when you personally haven't got much of a leg to stand on to enforce it..0

I am an owner of one flat in the building and of one share in the management company, my landlord is a freeholder, which I guess makes me his tenant as well as an owner of one flat.0 -

Thought about talking to solicitor you used to by the flat?
I guess your claim would be against the person you bought the flat from if you had reason to expect the area would be free and you agreed a price on that basis and the seller knew it was being used.
Have you raised it at an AGM? The mnagement company will have a duty to maintain cummunal areas and if they are not doing that you could try disputing their fees.0 -
Yes, I have to pay ground rent and service charge to my landlord.
The solicitor I used when buying the flat is as useful as a rabbit, I would not go back to him again for any advice - no point whatsoever.
The management company is my landlord, his wife, one young bloke from a flat on the top floor who is not affected by the problem that much and myself as only 2 flats out of 4 have been sold.
I bought my flat from my landlord who is also the property developer and I personally believe that he is responsible for fixing the problem at his own expense. I also believe that as a landlord/freeholder who is responsible for the communal areas etc he also has to deal with the problem. However, he of course strongly disagrees and says I have to deal with it myself and at my own expense. And I did try very hard, but failed. Now the only option is to go to court, but the case would be extremely expensive and difficult for me to win if I name the next door landlord as a defendant. He owes me nothing, as he already pointed out on several occasions. It would be much easier for my landlord to win the case, I just don't know how to make him start doing at least something about the matter.
I should be going to a solicitor of course, I just don't know how to find a good one/one qualified to deal with the particular problem and am a bit broke at the moment.0 -

If you are that confident that he is allowing the T&C to be broken dont pay your ground rent and service charge until the ground you rent is properly maintained according to the T&C of the agreement.0

I would send a letter, recorded delivery, to the person who's responsibility it is to re-inforce that people do not park in this area. State in the letter than unless the matter is dealt with by <date> (give them perhaps 2 weeks), that you shall be putting your own "private parking - all unauthorised parking will be clamped" sign up, and employing the services of a private clamping firm.
If the landlord takes the sign down, then it shows he perhaps has an alternative interest (perhaps making money from those parking???), which wouldn't look too good in court.
You shouldn't let it drive you to a mental illness... life is too short.
