How do you know they've defaulted you? Have you looked at your credit file?

If the amount is in dispute I'm fairly sure that they can't default you, all they can do is take you to court.

if a default has been registered on your credit file then raise it as a dispute with the credit fiel company and state that you have tried to resolve the matter with the company concerned without any success - they will then take up the matter on your behalf -

They claim i ticked a box which is like a signature , i cant remember any box.

oplus they admit its only a deposit account so why would it be a credit agreement , they have got me confused and i dont know where i stand ;(

Ive asked them to be more clear seeing as they admit its not even a credit account but there now ignoring me

Please let us know which company this is.

Was it a uk registered bookmaker (Gambling commission), was it a spreadbetting company (FSA) or was us a "gaming" company & where is it registered.

Have they provided "proof of debt" .

Have you asked Experian for a copy of your credit file?
The company may have sent you a letter saying "default notice" but this could just be a scare tactic.
My reading of this is that this is not a credit account, but they have issued you a default notice which in normal circumstances is followed up by a claim form (meaning a creditor is beginning proceedings in the county court (or small claims court).

Have you recieved a "claim form" from them.

My view is they have little chance of actually being able to get a court judgement on this debt but are using every means to scare you.

If you knew you were overpaid (assuming this is the cause of the dispute) then you have some moral responsibility to pay (although the number of gaming companies that make the rules up as they go only tempers this considerably).

Please post as much detail as possible.

Thanks kennyboy66 i really appreciate the help

I think its in UK , experian gave me a UK address to , Experian cant help as they wrote to the company in question but the company told them its correct and they want it to remain...even though they said it sounds like they shouldnt of done it , they told me Experian are just a libary and they cant take anything of without the Company in question permission.

I checked Experian & i noticed they defaulted me. its saying 8 in red , and its effected my credit score badly.

I asked for proof of debt , all they sent me was a form with my name and address and date of birth which they said i filled in online and also a copy of there t&C which they said i agree to when i ticked the box and also a copy of default notice.

Ive had no claim form , they told me they are going to give it to debt collectors to chase.

They have been quite rude , i told them they didn't supply statement of account and it should fo been supplied within 12 working days from my request and they more or less told me to get lost...they have also asked me to stop writing to them

Yeah, we really should know what company it is.

Head over to the Gambling Introductory Offer Loopholes board and post a message there, there are quite a few people in there who've had unpleasant dealings with bookies, and will be able to give advice.
They say it's genetic, they say he can't help it, they say you can catch it - but sometimes you're born with it

experian hold the data files and receive notifcations from finance companies etc of defaults - experian should have been procided with evidence or yourself of the alleged information relating to the dispute.

you could threaten them with court proceedings and pursue it through that route - the costs would only be the issue fee itself and the hearing would be held in your local court not theirs as they are a company.
