Unless you are a single parent... or a whole raft of exceptions and it's not just IS claiments but there are complicated rules and someone like CAB/shelter would be a good first point of contact.christabell wrote: »Interest is paid by the DWP if
1. The mortgage was taken out before 1995, I think it is a 9 week wait
2. Only after 39 weeks if after 1995
Can you not change to a Repayment mortgage?0 -

But I'm a single parent, and I've been told that if I come off IS and onto WTC for 16hrs a week, then I lose my mortgage help. How's that then?0 -
this deprivation of capital is like if you blow it in x number of weeks, if you get say 20k and blow it in 2 months then yes they will prob kick up a stink, if however its over a year they wont.im putting some as a gift for kids as its for there education and the rest living off, as they council said to me its not up to them what i spent MY money on . its up to ME
Robwend,
Please, please read the link that I have given. Yes, you can spend your money on whatever you think. But if you try to claim to claim HB , the deprivation of capital rule will apply.. I am not being argumentative. Please check this out. All the facts are in the link that has been posted. Go to CAB or a solicitor on legal aid or a solicitor who gives a thirty minute free consultation or to the free benefits adviser (the title may be different at your local council). Please also read the posts
from others on this forum. Try a different forum - uk.legal. moderated or uk.socialsecurity. or landlordszone or any other ...there are loads to be found via google.
Above all, take advice before you do anything drastic. This genuine advice applies to anyone reading this thread as well as Robwend.
Best wishes, whatever you intend to do. I can say no more.

people who work in benefits offices are not stupid - they check and re-check and then check once more just to be sure.
if they suspect you are playing foul they will stop all benefits until it is proved what you can have. This recently happened to a mum I was supporting after she lied to benefits office. It has taken 4 weeks to sort out during which she has had to have emergency loan from social care and has been investigated by social worker as she had no money at all and was in deep doo doo for a while.
My suggestion is always play fair because in the end your past will catch up on you and its not worth the agro this can bring to your life.

How can they say it is Deprivation of capital if you are genuine and can prove you are helping one your children to buy your house? Im not trying to fiddle anyone here, just help my daughter and dropped the price for her, yes she has to use the 25.000 for the deposit, which she will never see, nor I, its not a loan its a gift to help her. not all the 25.000 is mine half of that is my ex partners so, in total ive given her 12.500. this has caused me to worry more now, nothing was said by the solicitors who knows that i am not working. sounds like I cant win either way, my house was devaluating fast, on the market for 3yrs with no interest. was better to sell now at a lower price and let my daughter have it at a price she could a morgage for. I see it as selling the house for 100.000 instead of 125.000. getting really stressed here.this deprivation of capital is like if you blow it in x number of weeks, if you get say 20k and blow it in 2 months then yes they will prob kick up a stink, if however its over a year they wont.im putting some as a gift for kids as its for there education and the rest living off, as they council said to me its not up to them what i spent MY money on . its up to MErosebud0 -

The reason it may well be considered deprivation of capital is that you could have sold the place to someone unrelated to you for a higher sum. That means you have chosen to have less money than you could have had....much enquiry having been made concerning a gentleman, who had quitted a company where Johnson was, and no information being obtained; at last Johnson observed, that 'he did not care to speak ill of any man behind his back, but he believed the gentleman was an attorney'.0
