My son moved in with his girlfriend, he is on incapacity of approx £70 a week and DLA benefits. The assessment was done on last years salary figures 2006 - 2007.( He was getting paid full pay and then half pay by his company and then went on incapacity) They are now taking off her £100 a week!!! , she is therefore £30 a week worse off. How can they do this when he was not with her when getting this money?? We have made many phone calls and they say that its correct. I seem to be banging my head against a brick wall, but it can't be right.

The only way TCO can assess a new application is to ask for the last complete years income from the applicants. It doesn't matter if they were together or not. That year was 06/07.
When your son and his gf do their end of year annual declaration (it should be with them soon) they can confirm their actual 2007/2008 incomes and if they are owed anything for the 07/08 award it will be paid to them. TCO will then use the up to date 07/08 details as the basis for the 08/09 award. It is therefore in their best interest to complete the declaration as soon as it comes in. Thankyou for your reply. I will pass it on. They were quite alarmed as the tco were assessing that they had to pay approx £2,000 back on the 2006 to 2007 figures. I phoned and enquired and so did they and we got different advise everytime. I couldn't believe that it was right, we weren't told that they would make an adjustment when the proper figures for that year were received. Thanks again.0

Hi, Yes his girlfriend is receiving £100 a week less than she was getting before my son moved in with her and he is receiving £70 in incapacity. I have told her that when she gets her renewal pack and the figures are updated for 2007 to 2008 then it will be readjusted.0
