Hello everybody. Took a load of advice from this site regarding bank charges.
I have got an account which is is made up almost entirely of charges. They want their money back and have been making all sorts of threats such as black listing me (which I know does not really exist) and defaulting my a/c.
This is part of the letter I sent, taken from this site:
"I note from your latest correspondence that you are proposing to issue me with a Default Notice on this account. I need to make you fully aware that I am disputing the sum owed and, as such, you must refrain from any further action until this dispute is fully resolved. <o></o> The current Banking Code (Section 13.6) states: We may give information to Credit Reference Agencies about the personal debts you owe us if: <o></o>
</o> However despite this they are calling me every day which is rather stressful as well as annoying. What should I do? I haven't answered any of the calls because they go nowhere and just consist of a load of threats. (This is NatWest Birmingham Collections centre btw).
Any help or advice would be much appreciated.

- The amount owed is not in dispute; and <o></o>
- You have not made proposals we are satisfied with for repaying your debt, following our formal demand. <o></o>

Send them this letter:Dear Sirs
Harassment by telephone
Account Number: XXXXXXX
I am writing in relation to the quantity and frequency of telephone calls that I have received from your company, which I deem to be personally harassing.
I have verbally requested that these stop, but I am still receiving calls. (Delete if necessary)
I now require all further correspondence from your company to be made in writing only.
I am of the view that your continued harassment of me by telephone puts you in breach of Section 40 of the Administration of Justice Act 1970, and the Protection from Harassment Act 1997.
If you continue to harass me by telephone, you will also be in breach of the Communications Act (2003) s.127 and I will report you to OFCOM, Trading Standards and The Office of Fair Trading, meaning that you will be liable to a substantial fine.
Be advised that any further telephone calls from your company will be recorded. (**Even if you don‘t yet have recording equipment!!**)

Ok I note that they are still charging me interest and charges despite my letter. Is this the kind of thing I should reply with?

I once again remind you that I am disputing the sum owed and, as such, you must refrain from any further action until this dispute is fully resolved. <o></o>[/FONT]
[FONT="]The Office of Fair Trading Code of Guidance states: putting pressure on debtors or third parties is considered to be oppressive; this includes ignoring disputes about whether money is owed and refusing to freeze action if the debt is in dispute. [/FONT]
[FONT="]If you do not cease I will report you to them.<o></o>[/FONT]
[FONT="]I therefore hope to receive your full co-operation in this matter and would like to request a written response to that effect. <o></o>[/FONT]
