Would I be able to take them back for a refund even though I have accepted them by opening the package and not finding a fault at the time of examination?

So I still need to phone up M&S to tell them that I have examined my y-fronts in the comfort of my home and therefore accept them.

No, they don't need to know you've accepted them, (this is getting confusing talking about acceptance when we're dealing with contracts as obviously in this case we're not meaning "acceptance of the offer") there's presumably an implied acceptance, possibly only when the reasonable time has lapsed, of the condition of the goods unless you expressly don't accept them within a reasonable time.

    Good evening campers,

My missus went into town last week and bought my lad a couple of Man Utd tops (I know, I know). She got them from Sports World. When she got home it transpired that the tops were too large so she went back into town today to exchange them fo smaller sized tops. Unfortunately Sports World did not have his size in stock so my missus asked for a refund - she had paid cash. The young bloke behind the counter said it is not shop policy to give refunds and could only offer a credit note. She called the manager who said the same thing. Normally my missus would argue the case here but she was getting nowhere with these two. She has details of the head office and the store managers name and I intend to write to complain but I thought I had better check my rights on here first. The original tops were undamaged and were paid for with cash. They could be put back on the shelf for resale. The good were returned within a couple of days. Could someone be good enough to advise where I stand on this and if there is anything I should say in my complaint letter.

    Thanks in advance

To get back on topic - can't see the problem with the credit note if you want the tops, and just wait till the size is delivered.

Compared with other large stores, Sportsworld have a pants refund policy and I won't shop for DS if he's not with me. Matalan used to have a similar 'no return' policy but that changed a while back - maybe they were inundated with 'faulty' returns. ;)
