Fraudulent Car Insurance Claim - From over 2 years ago - Advice please?

Hi everyone!

To my disbelief I had a phone call from my car insurance company! Slightly strange as I have not owned a car for over two years!! I have spoken to them tonight and they have said that a claim has been made against my insurance from more than TWO years ago!! Unfortunately the department I need to speak to is only open Mon - Fri 9-5! The claim is totally fraudulant as I have never been in an accident and the details I have found out confirms this. However, as it is such a long time ago and I no longer own the car it may prove difficult for me to back things up if I need to!

I can't believe that a claim can be made totally out of the blue and was hoping that some money savers may be able to advice me??

    A person has up to 3 years from date of accident to claim for injuries and up to 6 years to claim for property damage (damage to car etc). It is not unheard of for a claim to suddenly crop up after this time and to help further we would need to know what they are alleging and what your version of events is.

    whilst i understand that they have three years to make a claim can a claim made two years ago be thought to be credable?
  • Well I don't know what the claims are yet only details of the accident. I can't really have a version of events because I wasn't there! I just need to know how to prove I wasn't there! I thought you had to report an accident at the time - surely if this doesn't exist the claim can't be made!

    If you need confirmation of when you disposed of the vehicle to provide to insurance company then you can request this from DVLA.

    You need form V888, it is downloadable from www.direct.gov.uk or DVLA can post it to you. It will cost £5 (cheque/postal order) and they will send you a letter confirming date of sale/transfer of vehicle.

    Hi - I work in the industry.
    (1) Request full details of alleged incident - location time, who was driving etc etc
    (2) Ask for any evidence - also why delay in claiming? etc etc
    I suggest your either fax/email your Insurers once you have details of what has been alleged against you. If you are still of the opinion that the claim is fraudulent I would ask that the Investigations Unit be alerted. Its fair to say however they would have started their own investigations into the third party claim sent to them.

    It maybe an innocent error by the third party when they have checked the registration number of the car and they have got a digit/number wrong.

    Dont worry about it - believe me it happens on a daily basis - keep me posted on how things go.

    Sorry for hijacking this post slightly but,

    I had a bump a few weeks ago, the attending police officer, after talking to the other driver, said i was going to be fine as she had practically admitted it was her fault.

    This week i had a letter from her solicitor stating it was my fault and i should pass the letter to my insurers.

    Is this normal?

I'm hoping it will be simple to sort out and like you say it may just be that a digit is wrong but it seems strange to make a claim now especially as the claimed damage would of had to be fixed at the time?! I will follow what you have recommended on Monday and fill you in on the situation!

    Chilli dog - let Insurers sort it out -"practically admitted" is not an admission and the Insurer will not accept FULL liability if they can argue that some liability rests with you and save money!
    Advise Insurers of accident tell them full circs and await developments.

    When you say you weren't there, are you certain. For instance, is it a part of the country you have never been to before or is it because you were out of the country at the time.

    One possibility you need to try and rule out is that you have somehow caused an accident but been oblivious to the consequences. It might be that somebody involved in the accident has then gone to a lot of time and trouble to trace witnesses, one of whom has pointed the finger your way.

    Of course, as Moonbeam says, these things are often errors in reg numbers or possibly even cloned plates but it really help to try and place yourself elsewhere at the alleged time / date of incident. Of course, trying to prove your whereabouts 2 years ago is pretty difficult for most unless you have a very good diary.

    Other clues as to your whereabouts would be bank/credit card statements, showing where you were spending money on the date of the supposed accident.
