Breach of contract

Hi,

I bought an item via the internet for 25 pounds and the company advertising has not followed their TCs. Purchsae was made via credit card.

Is it trute that I can refuse to fulfill the payment with my credit card company and that they have to pursue this on my behalf?

Is there any "excess" involved?

    The Consumer Credit Act is in place for claims of this nature but there is a minimum £100 threshold before it applies.
    However, that shouldn't stop you from speaking to your card company and explaining the full circumstances. I've successfully got refunds on amounts of less than £100. There are no excesses.

    What has the seller failed to adhere to ?

    Hello Exel,

    It is one of those website where you can get info on whether a property or land is registered. They promise delivery within 7 days but it has been weeks and nothing has appeared.
    They have ignored reminders as well.

    How did you convince the CC company to fight your cause for less than £100?

    If you paid by credit card I assume you went via Paypal ? If so advise them and they may well refund your money.
    It wasn't really a matter of convincing them, I just explained the circumstances and as a gesture of goodwill monies were refunded, but it doesn't hurt to mention the CCA when talking to them. In reality I don't believe they all bother with the £100 threshold as in your case £25 is a tiny amount for them to argue the toss over.

    Thanks for the advice.

    The company website mentions that payment is taken via hsbc through an encripted system. Could I maybe approach hsbc and explain the situation ? i.e. their customer breached TCs and is it possible to have a refund.
    I bank with HSBC too, could this help?
