Double glazing issue - legal advice plz

Hi,
we bought double glazing from CR SMITH factory direct and had independantly fitted saving thousands. We have since noticed that one pain has lots of pits in the glass, it is almost like welding/grinding sparks have landed on it and melted the surface. The uPVC frame is intact so can only assume this took place in the factory or they purchased the faulty units. A call to customer service got nowhere, they say the glass is not covered by years warranty and we only had a 48 hours period to report issues. We have just had an extension done so building has not been in a suitable state to notice till we moved in 2 months after windows were fitted.
Does anyone know of my rights?

I think you might need to threaten them with Legal action. The Glass unit will be covered.0

Find out the price of a replacement glazed unit and then decide if that much money is worth the hassle of court action etc. Sometimes the best thing is just to move on.0

You said it Michael, you failed to check something for which you paid good money.
Or the fitter should have mentioned it.
How would CR Smith know if it was them or your fitter., who caused the damage.Could also have been someone else on the site, maybe a plumber grinding down a pipe.0 -

mm, I tend to agree, the fitter should have noticed it. From CR smiths point of view they dont know who caused it....
But who knows, you could try calling trading standards and ask for advice see what they say. If you then tell CR Smith you will talk to trading standards they may replace it anyway, a piece of glass will cost them next to nothing so they may agree to replace it just to get you off thier backs so to speak

All too often, people on this site are wanting to cut costs, and do it on the cheap, then wonder why they have problems.
The problem is one of contract. If you contratced to CR Smith a s a trade buyer, then their terms and conditions apply. They may have no warranty, 12 months or 10 years, but some companies limit their warranty (as they can do, theres no law to say they MUST be guarranteed, just fit for purpose) to just a few days. You purchased, your problem, however they wouldnt want bad publicity, if the marks are inside the glass there is a visual standard. Effectively is you can see a mark from 2m (I think its 2m may be just 1m) in north day light, then its a real mark and should be dealt with, if however its not then visible its not an offical mark!
The indepenedent fitters did just that, fitted the products. They may have damaged the units, but that would have been on the frames too. If thats the case you must prove through the courts that they did the damage, but again that may be worth the threat.
Otherwise I tend to agree with others, use some of the thousands you saved putting the job right, and be gratefull you have some change, lots of times it ends upo costing much more!!!!
