Advice Please Littlewoods and Debt Managers Ltd

Hi All,

Can anybody offer any advice on how i should deal with the following.

I have several catalogues who now come under the Littlewoods banner, i lost my job and for months now i have been trying to offer payment with regrads to my outstanding acounts, as my acounts had returned and outstanding items on them i wrote asking for copies of statemnts in order that i can agree the amounts outsatnding and make a offer of payment.

So far thet have not acknowledge any of my letters even those sent recorded post but instead just kept sending me debt collection letters.

Today a letter came from Debt Managers Ltd stating that teh debt has now been legaly asigned to Phoenix Recoveries UK Ltd S.a.r.l acting on the behalf of its compartment SDFS Recoveries and asking for full payment within the next 7 days, also enclosed was a photocopied letter adressed to myself from Littlewoods finance giving notice of assignment of debt to Phoenix Recoveries and stating any payments or communications should be made to Debt Managers Ltd.

Apart from all this being very confusing on closer inspection of this photocopied letter there are very fine lines running along the top and bottom as though the header and footers have been added and is in the same font as their letter.

Can anybodty please advice on what i should do next as i am very suspisious of this.

  • Phone littlewoods and confirm the authenticity of this first. Tell the agents that you need littlewoods to confirm it to you before you will deal with them.
    £8k to pay off before Jan 2011! Was 28k to pay off by Jan 2010 though so I'm happy :)

    Since this is a catalogue debt, can I ask when you opened the accounts?

    Unless it was very recently, they are bound to produce a signed Consumer Credit Agreement and it is quite common for these to be missing. In which case, you do not have to pay the debt.

    I opend my cat acounts at least 12mths ago
    How can i get a copy of my credit agreament when they wont reply to my letters, this is what is frustrating me as i have been willing to sort this out from day one.

    If your catalogue agreements are close to being less than 12 month old, then be aware of this part:
    The rules affecting catalogue debts have changed under the Consumer Credit Act 2006. If you take out your catalogue on or after 6 April 2007 the court can no longer automatically declare your agreement to be unenforceable, for example if there is no signed agreement. It is now up to the court to decide whether to allow the creditor to enforce the credit agreement or not. This will depend on a number of factors.
    It is the law that they must provide you with your agreements if you request them using the example letter.

  • So if i ask for a copy of my agreement i do so from the catalogue company, can i also ask for something to proove the asignment of debt is genuine.

    No. You send the request to whoever is claiming the debt. They must then by law obtain a copy of the original agreement from the catalogue company. They will only be able to do this if they have legitimately bought the debt.

    OP will pay these debts off if DM have the required documentation.

    If that is not available, they s/he does not have to pay.
