common financial statement

Options
I had my bank send me a letter saying they acknowledge reciept of my complaint about unarranged overdraft bank charges. It says they believe the bank charges are fair and that they do not believe the Social security act 1992 prevents a bank from applying charges to a customers account when they have insufficient funds to cover a payment they have asked us to make. They say they don't know how long the case will take. I live in Scotland and it says something about taking the claim to the FOS or courts in Scotland. There is also a form included they want me to fill in and send to them it is a Common Financial Statement which asks to be completed and independently verafied by a specialist debt counselling agency? If I don't fill and send this back to them will my claim be ignored?
