Listed as new but definitely not!!!!

I recently purchased a lunchbag for my son as he has just moved to sandwiches for school lunch. He was after a doctor who one and i found one listed as new and sold because it was a duplicate unwanted gift with lights and sounds. I bid won and paid straight away via paypal.
It arrived today the sound is ok i suppose, the lights do not work (not mentioned in listing) and it had old food in the flap and on the zip part and inside the bag. To me this isnt new and has obviously been used. I'm not happy, if it was stated in the listing it had been used then ok i would have let it slide (well maybe not completely with old food on and in it) but it was listed new.
I sent this to the seller am i too harsh?
I am not happy with the condition of the lunchbag you have sent me, it was listed as new, and has arrived covered in old food. Also the lights do not work. I am seriously not happy, why list this as new if it has been used? What are you going to do about it?
As a seller myself i would not send something out in this condition even if it had been used. Where do i go from now?

that sounds fine. it could of been much harsher than that.
wait for their reply. if they offer a refund or other solution, you're sorted.
if they dont, open a item not as described disputehelpful tips

Agree with brettcta - it sounds fine. Wait and see if they offer an exchange/refund - if they don't - open a 'Item Not As Described' dispute. Worth it as they lied on the aucion page.

I 'won' an item of clothes as 'new' it arrived stinking of cig smoke, no mention of this in the listing.
I mailed seller and told them, got back reply along the lines of :- it is new what more do you want! So I neg her with the reason of cig smelling clothes.
About 2 weeks later I got a mail from her, saying she was on hold from ebay as several people had now neg her over the cig smell, and would I mind removing my feed back, so she could trade again!!Breast Cancer Now 100 miles October 2022 100 / 100miles

If it was a legit feedback because it was listed as new and had cigerette smoke smell on it - don't remove your feedback. You have a right to warn people if what you get isn't as it was listed.

We had the same kind of situation a while ago. Hubby bid on and won a multi media keyboard, listed as new. When he received it and took it out of the box, inside the box was a printed off e-bay page from when the seller originally bought it off ebay. What a numpty! :rotfl: He bought it as used but sold it as new.
Hubby wasn't that bothered as it was in good condition and he got it for much less than the seller paid for it and much less than his max bid.:heart2: Love isn't finding someone you can live with. It's finding someone you can't live without :heart2:0
