Di, i am going to send off my complaint for unfair terms in contracts as i think that although it was April 2007 that the Ombudsman could deal with consumer credit complaints I think that this was just that they took on the complaints of people holding consumer credit licences. My complaint is about a bank (the banking code etc) as I am putting Barclays Trading as Firstplus so maybe they can. Just have to see. Its can't do any harm can it??

If it gets thrown back then at least I have exhausted my options here and then its up to me if the courts should be my next step.

    What do you think??

I do think their terms are unfair so I am going with my gut feeling here.

Great idea hun, if you don't try you will never know, so yep go for it hunni.;)
Are you going to keep this separate to the mis selling side of it ?

Yeah, i have done a seperate complaints form but have done notes of my complaint already in about unfair rebate (not misselling) and the complaint number of it. I will not settle until i have done this. According the M colak i was disproportionately rebated on both the loan and PPI so if they are two completely different bits of legalisation then I will HAVE to do two complaints. Its seems stupid to me but they must have their reasons for this.

    Barclays came under compulsory jurisdiction.

Good, and yes you need to do this hun, I have a feeling this will be okay and it will get looked at, and yes by keeping separate its the best way round this I think.
Go for it hun, you may regret it if you don't.;)

  • Hopefully someone can help.....

I took out a loan ~3 years ago (£10500 over 60 months) and was [STRIKE]bullied[/STRIKE] mis-sold into taking PPI - or I would not get the loan.

After a month or two of having the loan I then asked to cancel, and was told that this would be a new application, so I went along with this.

I signed the paper work for having a £10500 loan now over 59 months, and no payment change (has always been £241)

Can I still reclaim PPI as I think the loan amount / time has been tarnished, but the 'policy' has been cancelled.

    Hi there.
And yes I would definately try to reclaim on this, because even though they may have re-scheduled this for you, you were pressured into taking this, give it a go, do you need the template for this?;)

Check this out, there is also a template on this link too.

    Good luck!

What you could also do is request a copy of the breakdown on this, they acc details should be on that actual paperwork.
You have the right to request for a copy of your agreement.;)

Was there PPI on the new agreement or not. As this was a single premium then you would have paid interest on this as well and who was this with??

You can try on the first one due to the PPI, and as they to my knowledge generally re-calculate this , did they refund you with anything at the time?

If not even though its just the 2 months, you could try reclaiming the ppi on the first one, plus charges and stat int etc, afterall they made you take this/being pressurised.;)
