Have you received any written reponse from them at all? If not send them one more letter explaining your grievences and if they don't respond to this and let you know what the current state of play is you will be contacting the information OFT in respect to their lack of a structured complaints procedure.0 -
thankyou to both of you. off to send them another letter now.
many thanks again0 -
You should have had a quoted a total repayable figure given to you. If you then take off the insurance and interest and divided it by the period it should have given you the total monthly payments due. If confused post the figures and I'll have a whizz for you.
dont have any paperwork. the loan was for £4000 and the interest rate was 7.66%0 -
Dear M.Colak
No i have not submitted any papers just what i filled in online money claim.
I feel i am a bit out my depth here.
I have printed a copy of FSA single premium payment paper, the paper from the FSA firms agree to change the way they sell PPi over the internet, FSA consumers to benefit from PPi refunds agreement and the FSA The Sale of Payment Protection Insurance - results of follow-up thematic work. Is this the sort of thing to send
So i have to issue the papers in support of my claim to the local court, but do i have to pay anythink else like this allocation fee they have said about.
Thanks

Hi,
i have breezed throughout and i think the saliant points are:
1.The company added PPI to the original loan after signing and therefore yes this is illegal as it wasn't agreed in the original contract.
2.The company changed its operating name and therefore reregistered itself with company house at this time it should have notified you and again it was remiss as this might have had financial consiquences on you.
3.The original loan was passed from one company to another without notification to yourself that this would be the case. Which again you should have received notification.
The agreement and the application that we made do not match. The application is signed by us asking for a loan of £17k over 120 months with repayments of £280 and the actual agreement states ppi added and the term has increased to 160 months but still about £280 repayments.(and we signed that too as it was a condition and pre typed in when we actually received the agreement) Is there anything legal about the application differing from the agreement.
Do the FOS deal with cases like this or will they say you actually signed the agreement and the application means nothing in law0 -
Sorry for my ignorance but what is rule 78?0

Yes you need all those plus you also need a copy of your original loan agreement plus the working out for how you derived your figures plus the paperwork relating to their response's to your requests for reimbursement of the PPI. Sorry for asking this but on what grounds have you taken them to court over (if you don't mind me asking?)0 -
