Thanks again Tiggrae, I was one of those people who didn't open statements and buried my head in the sand for as long as possible!!

    I owe you an e-pint!
oh I'm very familiar with that sand pit - been there many times myself !!!!

A loan company will ALWAYS calculate a settlement which is to their best financial advantage NOT YOURS and it's probably all written down in their terms & conditions that's how they will recalcuate it - so that when you challenge it they'll say 'well it's in your terms and conditions and you signed the agreement' The thing to do as a consumer is say NO - that's unfair and that is reason and the basis of the Unfair Consumer Contract Terms Regulations 1999 and that's what you need to base your complaint upon
I have put this on my FOS claim form. It states that i think the settlement is unfair terms (although i have not stated the actual act) and also i have written that it was extortinate credit in my eyes. I have waffled on about the ppi thing as well but my main claim is the settlement was very unfair. The FOS did ask if i signed anything at the settlement and i said i did not think i had as my solicitor sorting the new mortgage (to pay these robbing B*****ds off) asked for the amount and paid by CHAPS.
I should let them have these letters i received on Saturday though shouldn't i as they have stated that an amount should of been deducted and was added.

Iv'e got a silmilar situation, the settlement figure in july 04 is actually £1000 less than the one for june 08, and thats paying back £329 a month! I have been trying to work that one out.
Who was your loan with. Its crazy isn't it.
  • The associates who then became citifinancial, the ppi i had no choice over (ahem) was 7,541.!

The interest rate was stated at 15.7 % but could be variable with notice, as far as i'm aware i have not received any notification of a rate in change. I find this companu very tricksy to deal with!

    Quick Question................

I have sent my letter to barclays and added the following points
    • your salesperson stated / implied that taking out the policy would assist my credit application
    • your salesperson did not tell me that the policy was optional
I also phoned barclays to cancel my PPI and was informed in order to do that I would have to take out another loan and there is no guarantee the rate would be the same.
I did not include that in my letter

Shall I write to barclays again or should l wait to see their reply?

    Thanks

I have been looking through my car agreement and noticed I have Gap insurance, at the time the Salesman said I would only be able to get the loan if I took out the GAP insurance out aswell. Mis-Selling???
Can I reclaim back just like PPI?

Hi, sorry to sound thick, but what do you mean by upfront payment?
And the loan was just in his name.

Right, have hunted high and low for the original agreement. Can only find the PPI agreemant which doesn't mention any amounts dating 2002.
Not sure if it's a single premium policy.

The application was done online, but we have rung Barclays on a number of occasions in the past to try and cancel PPI. We were told we'd have to reapply for a loan.
Do you think we were mis-sold ?

    Thanks

Ring and ask for a copy of the agreement to be sent to you. It sounds like it was missold. Have you ever requested a settlement figure.

By the way, i did not put them angels there. I copied and pasted from the FSA register and they are there. They were registered by the FSA on 1st December 2001. Your loan was 2002 as i have just looked back at your posts and i would say there is something wrong somewhere. You are lucky though as they are someone that the FOS will be able to help with as they were regulated.
