    I think Click will wish that they had dealt with this different. Its actually a criminal offence here that may have been committed and also an imprisonable one is it not???

    Other recommendations included improving a hotline for people to report unfit directors who breached court orders and increasing awareness among company directors about disqualification laws.
    The Insolvency Service is an executive agency of the Trade and Industry Department and is the main body responsible for administrating laws on company director disqualification.
    Most directors banned from running companies are disqualified after their business is declared insolvent.
    About 4,300 individuals are currently disqualified from acting as a director or being involved in managing a limited liability company. More than 15,000 companies were placed in formal insolvency proceedings between 1997 and 1998


    Thngs have changed then since this report as they don't USUALLY disqualify them if they go into liquidation. They grant them another licence to do it all over again (and again and again).:mad:

    I think its only an offence here if they are disqualified and trade again...

    . A company will be considered to have been trading fraudulently where it appears in the course of its winding-up that business has been carried on for fraudulent purposes, or with intent to defraud creditors. In these circumstances, the court may declare that any directors who were knowingly parties to carrying on the business in that manner have personal unlimited liability. Fraudulent trading is also a criminal offense and the directors may be punishable by a fine, imprisonment, or both. The criminal offense applies whether or not the company has been, or is in the course of, being wound up. A director could also be disqualified from taking part directly or indirectly in the management of a company for up to of 15 years. A director may be made personally liable if the company has gone into insolvent liquidation. This arises where, some time before the commencement of the winding-up of the company, the director knew or ought to have concluded there was no reasonable prospect that the company would avoid insolvency. Directors are unlikely to be liable if they have taken every step possible to minimise the potential loss of the company's creditors. A director cannot avoid this responsibility by resigning.

    Why can't these banks/lenders/brokers just pay back the PPI and have done with it. They know they missold and it was greed that got the better of them. Surely repaying the PPI is better than the cost of each complaint to the FOS and then repaying the money back anyway and also then the millions of pounds that they will eventually get fined by the FSA. I thought these people were "financial experts".

    PPI + FOS fee + Fine (plus bad publicity for their future business)
    PPI :undecided

    I know what I would prefer to pay.;)

    Also where does the money go that the FSA get in fines. I have always wondered that one???
  • Hi all - am in need of some help! I obtained an MBNA Credit Card via an on-line application back sometime in 2000/2001. At the time of applying I am almost 100% sure that I could not continue with the application if I did not leave the tick in the insurance box. Since then I have transferred balances to and from the card a couple of times and each time no one has ever mentioned the ppi aspect of repayments when I was speaking with them when doing a balance transfer. Do I have grounds for reclaiming as I am insure? Many thanks in advance!

    I would certainly try to reclaim on this.
    Do you know if these were covered by GISC then ?

    Maybe someone else maybe able to confirm this, if this is the case I would definately try and explain your reasons as fully as you can and give them 8 weeks the usual time they have to reply to you.

    Have you checked out the section of reclaiming £1,000's ?
    There is some useful information on there and a template to help guide you through this, but I would try anyway.;)
