I have been trying to get my credit card statements from lloyds TSB now for over a year, after £30 and several letters i went to the information commision who told lloyds to hand over the statements as i had requested.
Lloyds have told me and the Information commision that they only have the first four statements on record (october 2001, november 2001, december 2001 and january 2002) and have provided these and they are officially telling me they have no other statements for a card i was still using in june 2004. When the card was deactivated (long story) it had an outstanding balance of £6300 (I know this due to a court summons for the amount back in 2004 which led to a ccj) but I can't say how much of that was lloyds charges although i know it was a lot.
Should I send a letter asking for the full amount as neither me nor lloyds can tell what is what regarding charges, or should i just ask for half or nothing.? I don't want this to goto court and lloyds magically hand over the statements even after informing me and the information commision they do not have records of the statements.?

It's not a good idea to claim for an amount you have no evidence for. If it does go to court, you need to show you were charged. You can claim for those charges you have details for. Has the Information Commissioner accepted that Lloyds don't have this information?0
