Advice Needed - Shop Wont Refund Me "Faulty Motherboard"

Hi,
i purchased a £175 motherboard last Thursday and put it together on Saturday but i kept on getting a Hardware Malfunction BSOD (blue screen of death).
I removed the cpu and looked carefully inside the socket and noticed 2 pins out of place so i`m certain this is what is causing the motherboard to crash all the time.
Now i contacted Scan this morning to request a RMA and was basically told that i caused this due to incompetence and i should of noticed these 2 faulty pins out of the 775 in the socket before i put the cpu in.He said it was impossible that the board would of shipped like that new.
I got told on these grounds the RMA would be refused and all they could offer would be to try and straighten these pins themselves at a cost of £35 to me,£15 to send the board to them and £20 to send it back to me even though this would not guarantee the problem to be fixed.
Do i have a leg to stand on or do i just have to accept what they are saying?

If you paid by credit card you could contact your card issuer and ask them to CHARGE BACK the card because you were not satisfied with the quality of the goods when received. You should also inform your bank or card issuer of the attitude displayed by the merchant to your complaint.
You certainly DO NOT have to accept what they are saying if you know yourself to be in the right.
I should write to the merchant and advise them of what you will be doing, give them seven days to refund the cost of the board including your postage costs to return it to them, otherwise you will have no option but to instruct your bank to charge back the purchase.0 -
I paid by Electron can i ask for a charge back with that?

The SOGA means they have to prove the fault didnt exist when it was shipped so a refund or replacement should be issued
However if they can show it was fine when it arrived or you have been incompetent then you may have problems doing this0 -
I think you may be in for trouble with this one as all boards are inspected and sealed at the factory0

But the contract is with the shop, not the factory, as such the SHOP has to prove that it wasn't faulty. This they are welcome to do by proving they tested the board before it left the shop but I seriously doubt they did ;-)
IMHO the shop can't rely on the line "all boards are 100% factory tested" as that proves nothing of what happened to the board between it being inspected at the factory and leaving the shop.

AFAIK if its a big company - they cant check every single board they put together as it would cost too much money to the company and slow down the production so i think like most manufactuares - they test a sample from each batch.
So i would say its the shop that has to prove it - not the factory or the consumer.

Just an update,contacted Asus and they said to send the board to Scan and if they cant fix it Scan will have to send it to them.
