Hello all,
Sorry if this is posted in the wrong place ! please feel free to move.
My Wife was killed in a car accident a few weeks ago, i have been trying to sort out all the paper work and bills etc since her death, i have no credit cards etc they were all in her name, although i have the main income for the house, i dont have a very good credit history so it was all dont in just her name. i have call all of the card company's to inform them of the death and im in the process of sending copys of the death certificate etc to them all at the moment. i have to say that 90% of them have been very nice with the only one thats not being Barcley card, they have been calling and leaving messages for me every day, i have not been getting in till late and there office is always closed when i call back. but my question is this, What can the company's do, can they turn around to me and demand payment out right of the debt ? there is about 6k in total but i just dont have that kind of cash !! can they send the bailiffs round ? there was no insurance on the cards etc
thanks in advance for your help, its been a bit of a cruddy month so far and i can only see it getting worse at the moment with all the card company's !
thanks
Matt

Hi there, and sorry to read about your loss.
The key will be whether your wife had any assets. If she did, then these will need to be used to pay the credit cards.
If the "estate" consists of no assets, then there is nothing to pay the debts with, and the debts will have to be written off.
The debt cannot transfer to you. If there are no assets in the estate to pay the bills with, you need to write to them stating this, and requesting that they stop hassling you at what is already a difficult time.
Martin has, I think on the relationships board, done a thread on what to do after a death - would probably be worth having a look at that.
