Faulty laptop

Hi,
I was wondering if anyone could help me please.
I have a Samsung R40 laptop which i have had for 16 months now.
When it was 14 months old it developed a loud buzzing noise so i took it to my local computer shop who said the fan just needed cleaning which they did.
It then just started again so i took it to someone else who said it would need a new fan but it would be a complicated job.
I then rang samsung to say that it had this problem and was disappointed that it had gone wrong so soon.
They said as it was out of the warrenty it was tough and they couldn't do anything.
I then took it to another pc shop who had it for 3 weeks and said that it was all to do will the fan being too close to the bottom of the laptop and everytime i knocked the laptop it would start off the buzzing.
Changing the fan would be no good as it was a design fault and would just keep happening again.
I wrote to samsung again and they are taking no responsability for the fault.
I was wondering where i go from here ?
What are my consumer rights regarding this situation?
Do i have to get a new fan fitted at vast expensive for it only to happen again?
The buzzing is really loud and not something you can really just live with.

If it was a design fault then it would have developed immediately and not after 14months. You will probably find that the fan is just filthy and needs cleaning. The shop might be "trying it on" to get some money out of you.0

The warranty is irrelevant, it's additional to your statutory rights.
A laptop should not develop a fault after 16 or 14 months so I'd get back on to Samsung or preferably the place it was bought from - your contract is with them - and don't be fobbed off by either.
Do bear in mind though that the laptop has been opened by someone unauthorised (if they did, they might have just blown into the cooling slots!?) so that might cause a problem if any case seals have been disturbed.
Wise after the event but I would have gone back to where it was purchased or contacted Samsung at the 14 month stage before taking it to the computer shop.0 -
Samsung are not responsible, it is the retail outlet and you are going to have to prove that it is a manufacturing fault, which it probably isn't.0

I should just add that I got this laptop from a claim I made on my house insurance when water was spilt on my old one so I can't really take it back to them.

Why not? It doesn't matter how you got the laptop (legitimately), if it was new then it should last for more than 14/16 months before making noises.
Was it new, did the insurance company arrange supply, voucher or other, or was it a "refurb" which returned you to a similar position to before the water spill?
For any informed advice you really should submit the complete scenario in your first post. Sorry, not having a go!0
