Basic CCA questions

I am soon to kick off a DMP with CCCA and looking on this forum I'm reading stuff about CCA and CCA letters.

Trouble is it feels like I've come into the pub half way through a really interesting conversation at the bar and I can't catch up.

From what I can gather, I need to write to my creditors asking for copies of our CCA and they have a time limit within which to respond.

If they cannot provide a CCA, does this mean that I don't have to pay?

I have 3 cc's, one o/d and a revolving credit account with hfc finance. Does this apply to all of them?

Is this something which CCCS will help me through?

Can some kind soul please fill me in with the basics or point me to the thread which explains it all.

Overdrafts are not usually covered by the CCA74 and i've never heard of a revolving credit account.

Credit cards are covered and you can request a copy of the CCA using the template letters from the board. This thread should shed a bit of light on it.

    What does that mean?

Have you had bad service from cccs? Is it outside of their remit? Do you suspect them of being biased in favour of creditors?

Please expand on your one-line answer as it has not helped me at all so far.
  • Thanks Fermi, that makes sense.

I am happy to persue this bit for myself but could I do this at the same time as CCCS are handling the plan and making payments?

This also leads me on to a question of timing. Do I ask creditors for CCA stuff now or wait 'till it goes to DCA's? I am leaning towards the latter since they seem less likely to respond in time from what I have read so far.

If creditors are accepting your reduced payments then personally I'd be tempted not to rock the boat with a CCA request. If they don't however, and say that they're passing you on to a DCA then wait and then after the first threatogram from that DCA hit them with a request. It's not a guarantee that they won't eventually come up with the goods, but at least makes the DCA know you know your rights and are not going to be a walkover.

hiya im at this stage too, ive done my own dmp and the likes of mbna have already asked rma and global vantedge to speak with me about my arrears and payments but have had no responce to my pro rata letter and budget sheet sent to them. So today have sent my cca to Rma and tomorrow will send to Global vantedge for the virgin mbna credit card.

So am awaiting to see what responce i get back, will post back to alert everyone,

thanks for everyones posts, they have helped me no end, not to be frightened but to take control.

    Ciao for now
