    Where a Will leaves a gift to children and one of them dies before the person making the Will, then unless a contrary wish is shown, the children (if any) of the child (ie the grandchildren) will take automatically the share of their parent.

    You will need to look at the Will to see the wording (ie to make sure that the Will specifically doesn't state that this doesn't apply).

    It should state either way, but may not.

    If it's silent about what happens to a child predeceasing (ie dying before) then the grandchildren inherit.

    It is the responsibility of the executors to distribute the estate according to the law, and so if they haven't carried out their duties correctly they are personally liable to your partner.

    First of all you will need to get hold of the Will to see exactly what the wording is before tackling the executors.
