    Thank you for your order for the ELONEX 2GB,320GB Desktop PC inc 20" TFT monitor.

    Unfortunately, we are unable to obtain any more stock of this item from our suppliers and therefore we are unable to fulfil this order.

    In accordance with our terms and conditions as laid out at point 9, we have cancelled your order and refunded your card.

    Sure someone will put me right here, but if they took money from your card, isn't the contract formed? Certainly thats how it is under UK contract law, but as i said sure someone will tell me otherwise!

    hiya... this happens regularly on these issues (70p bouncy castles anyone!)

    but if the item is mis-priced or "unavailable" then the retailer can simply refund you.

    I owned a shop (albeit a little shop!) but if i mis-priced something then the consumer could not demand it to be sold at that price. same with any other company.

    I ordered from Asda Sunday morning and I see that it has already been charged to my credit card.

    I've not had the out of stock letter from them yet but I hope they credit my card quickly.

    under contract law, theres two parties of agreement, by taking yr money, they are agreeing to the consideration you put up, but by paying, you are also agreeing to their terms and conditions, which might include a get out clause for them... in this case, where there's no stocks

    I ordered one of these. So far I have not been contacted about delivery times etc. Does this mean I might actually get it - or was this one big blunder by ASDA/QED/Miller?

    Has anyone been contacted about when they might get their computer???:confused:

    the [SIZE=-1]Statutory Rights under the Sale of Goods Act 1979 gives consumers certain rights. Rights to refunds if faulty, right to change your mind within a certain period... blah blah blah.

    when an offer doesnt afftect your statutory rights it means you have all your rights under the sale of goods act..... i think!
