Can the other owner rent out our house without my permission?

I am the joint owner (tenants in common) of a house with my brother. It is currently empty. I want to keep it that way until it is finally sold. However, my brother wants to rent it out now. Can he do this without asking my permission?

Any advice welcome

    I wouldnt have thought so. If your brother does rent it you can as the legal owner serve an eviction notice.

    If he does rent the property you are entitled to 50% of the rent.

    however as tenants in common he could in theory rent out his half....reminds me of the episode of Steptoe and Son when they divided the house in half.

    Is your brother aware of all the costs, time and regulations with you becoming landlords.

    If he does all the research about any tax stuff, protecting the deposit, letting agent fees, gas and electric certificates etc etc all these costs may put him off.

    You are probably best reducing the asking price to get more interest in the house.

    Tenants being in the house may put people off (uness they are BTL) and the tenants agreement will be needed for showing people round the house.
