I just received a letter telling me I have been caught speeding on a local a road doing 61MPH in a temp 50 zone.
I travel on this road ever day and they have started doing roadworks, however the temp 50 sign has been actuially past the speed camera untill recently. It is alsop moved alot by the workmen.
I have a clean licence and feel that to get 3 points for doing 61 in what normally is a 60, and also I think the sign wasnt there. infact i'm quite sure it was behind the speedcamera.
Is it worth disputing the claim.. has nayone any expereince in doing this, does it normally go to court?
Thanks

You'd be better off in the motoring section of the travel forum. It's my problem, it's my problem
If I feel the need to hide
And it's my problem if I have no friends

MOVING THREADS FOR BETTER RESPONSES
Hi, Martin’s asked me to post this in these circumstances: I’ve asked Board Guides to move threads if they’ll receive a better response elsewhere (please see this rule) so this post/thread has been moved to another board, where it should get more replies. If you have any questions about this policy please email !!!!!!0 -
Workmen = slow down
Sorry mate but you havent got a leg to stand on, temporary camera or not you should always be aware of the signage, I thinks its a case of you know that road only too well syndrome and travelled at the same speed as if the road works were non existent, thats why Hi-Vis jackets are life savers.
Just pay up and/or get the points.
Sorry mate but I disagree. Speed limits are not always reduced where there are roadworks/workmen. The idea is to obey the signs .... and in this case the issue is the location of the sign which caused the ambiguity ... therefore, paying up should be the last resort as its not as clear cut as it sounds. If you found my comment helpful, please click the 'Thanks' button below :T0 -
i dont recall ever going through works when the speed limit hasnt been reduced ! its just common sense really whether there are workmen or not extra care has to be taken. usually i find the red/white cones are a give away !This is a system account and does not represent a real person. I could be wrong here but I thought that you can only get a fine for speeding in a temporary speed limit and that points weren't applicable?

There are plenty of cones at the North end of the M6 just now with a lane closure but no speed limit signs.0 -
Only Courts can issue fines. What you'll get is a Conditional Offer of a Fixed Penalty, which avoids the need to go to Court, and it's a standard penalty of £60 plus 3 points, regardless of whether the speed limit is permanent or temporary.I could be wrong here but I thought that you can only get a fine for speeding in a temporary speed limit and that points weren't applicable?

If there's an issue with the signage, you may want to find out from your local county council's highways department, the details of the temporary speed limit order, which should detail exactly where the temporary limit starts and finishes. If the workmen moved the sign without referring to this, to a spot not covered by the order, you may have a defence that the signage was illegal, therefore no case to answer.
However you need to be 100% sure of your facts and get your paperwork 100% in order, before you go to Court and take on the might of the system.

You would have been correct about six years ago, but it has changed.
