Credit Card reclaiming

Hi

Last year I sucessfully claimed old bank charges (thanks to all help and advice from this forum - and others)

I'm now looking at reclaiming Credit Card charges, but this is a little more complicated as detailed below, and I want some advice on where I go.

I used to have a CC with Lloyds, until very recently it was administered by Lloyds (they cancelled it last year however - for various reasons which don't need to go into here). Basically, they were using their terms and conditions to take money from my current account to pay the monthly payments, even though they had cancelled the card.

The CC has now disappeared from my online banking details, and I'm harried by Debt Collection letters (which I'm presuming are just another department at Lloyds)

Firstly, last year when I got my bank charges back they took a certain amount out to pay CC payments as mentioned above - I wasn't keeping up monthly payments.

So, if I claim CC charges are they likely to take any money outstanding out of anything reclaimed. As I see it now, being as it looks like the actual "account" is closed (its no longer showing as one of my accounts online) and they chasing for the whole debt amount, are they likely to 'steal' this money back after refunding if they pay it into my bank account with them.

Am I entitled to request a cheque payment, so I can pay it into another bank account?

I am toying with the idea of asking for various things with the closed CC account (like maybe making a part payment as settlement, and/or stopping the interest accruing). Should I keep this seperate, or should I mention it on my letter requesting reclaim of charges? ie I claim all my charges back, but I am willing to make this payment back to you as a full settlement (being as I'm on Income Support).

Any help appreciated, especially with wording on how to offer a part payment to finalise this CC account before I end up with a CCJ.

Thats what I thought - but then I was thinking that they could do that when I actually HAD a credit card account with them (it was in the terms and conditions presumably), but now that in theory I don't have a CC account with them... its almost now like an unsecured debt/bank loan, what terms and conditions is it now running under... ie as far as they are concerned I now owe them the full amount outstanding.
