BoS - Charged for going 37p over limit!!!

Hi all,

I'm currently in the process of moving from Bank of Scotland to Lloyds TSB as BoS have messed me about for the past couple of months with my Next direct debit.

Anyway, Lloyds were taking care of moving over all of my direct debits, but I've gotten home today to discover that one sneaked through on my BoS account - and they paid it, taking me a total of £0.37p over my overdraft limit.

BoS have sent me a letter stating I am being charged £35 on the 20th April for them paying the item, and £28 on 31st May for going over my overdraft.

Just to clarify - they paid a direct debit for £8.99 when I had £8.62 available, and are expecting to charge me a total of £63 for doing so!!!!

Surely this is all kinds of illegal?

Does anyone have any advice, as I don't have a spare £63 lying about, and if I did I wouldn't be giving it to these robbing gits over 37p.

    I had a similar experience with natwest where money went in the same day as a direct debit came out but the bank say the DD went out at 4am and the money was credited at 9am aking me 87p overdrawn. I got the usual charges.
    Just follow the reclaim procedures.

    Update - I received a second letter as a further payment for £1.50 had slipped through the radar & been taken from this account....another £35 charge letter.

    Spoke to BoS phone banking, they waived the 1st 2 lots of charges, but refused to waive the last one.
    So I logged a complaint.

    Just got the response letter, which basically says "no chance".
    They are refusing to waive a £35 charge over a matter of £1.50.

    I can't help but wonder just how much investigating this guy actually did, as I logged the complaint on Monday, and got the reply today saying no.

    So where do I go from here?
    If I don't pay money in to cover this charge (money I don't really have as it's before payday) then they'll apply it, taking me overdrawn again & I'm back to square one.

    But if I let them have it, I then need to try to reclaim & BoS aren't budging due to this court case.

    I really, really don't want to lose this fight, it's absolutely disgusting they can hammer me with these charges over such a piddly amount of money.

    Is there any point going into my branch to fight it out?

    Can't wait til I have the funds to clear away the overdraft & tell them to shove their account up their....you get the idea.
