anyone successfully challenged a planning rejection?

Has anyone here successfully challenged a planning application rejection based on its' depth being over the permitted set out in the council's policy? If so, what deciding factors were taken into account? The council have a 2.8m policy and mine is proposed at 4.65m.

    Wouldn't have thought you would have a leg to stand on going over by that much.
    Did you not speak to the planners before submitting your application

    the planners said that it would be allowable provided there was no objections. a (developer) completed on the neighbouring property recently. his intention is to develop (add small extension and full width loft), which he has now done and then sell.

    Im meeting planners on monday to talk through options including a step option.

    there is already a 7.5ft fence running along the boundary. effectively I can get 2.8m a height within reason, but not the extra 1.8m at about 1ft higher than the existing boundary.

    That may be an option steping it away from the boundary to get round the 45/30 degreee rule, did your architect not design with these rules in mind.
    To be honest the planners you originaly spoke to didn't give you good advice just because someone objects/doesn't object, is not grounds to refuse/grant planning permission.The development must fall within the remit of the local plan, planning policy.
    I am also a bit confused as to what you are saying when you talk about the height of the boundary fence as the 2.8m refers to the projection out from the back wall of your property not the height of the roof.
    What sort of a house is it what are the dimensions of the extension and do you have alink to the planning application on the councils website.
