help re small claims!!

hi to cut a long story short i have been working along side trading standards as i bought a wedding dress from a shop over email , picked it up and it was not the size stated, she offered a refund but i asked if she could alter it as it was in the sale and i cant afford a new one she said yes then i realized the shop is an hour away and it was a false economy (although we had talked about a day and time for me to visit) really travelling back and forth for fittings so emailed an politiely asked if poss to have original refund and she said no. so i replied ok but i would like to check with trading standards that i am not entitled to one first. she emailed back saying free alteration and that was it etc but this still meant the travelling , i was polite throughout our emails although she did get funny with me at times, trading standards informed as i agreed alteration no case for refund. fair enough. so i emailed lady and said look can we compromise sorry to bombard you with mail and to mess you about shall i come over and we can talk, she mailed back no sold shop am in ghana??? trading standards have said i have a case if she will not do alteration (have emailed asking her about this but had no reply), but shop is still trading as a limited company just with a slightly changed name.
right rant over i need to know do i chase shop or her and what is the time restriction for a small claim as i cant find any info on line xx thanks x

Chasing her is going to be impossible if she is in Ghana,
Chasing the shop likewise if it’s a different company running it.

hi no i didnt it was part cheque part cash on collection although trading standards have said if it is a limited company which it is i can go to shop directly regardless of whether she is running it or not although i still need to know time restrictions for a small claim xx0

time limit is generally six years but if it’s a different ltd company running the shop you are going to struggle as it is unlikely they will be responsible.0 -
/Is your case not complicated by the fact you have accepted certain things,then changed your mind,as well?.
Can you name the company?
When you say you bought it "over email"-how did you find out about the company in the first place?Didn't you notice there was no uk address then?
Do they make the dresses themselves,or are they "off the peg"?
Was it the wrong size ie a 10 instead of a 12,or was it just badly sized?
How much did you pay,and how long ago was this?
If you have been dealing with Trading Standards,why haven't you asked their advice too about who to sue?0 -
hollydays - from the way I read the OP, it sounds like the shop owner was originally in the UK, but they then sold the shop and are in Ghana.
zoena - how different is the name of the shop/company now to when you originally placed the order?
IMO, if trading standards have looked at the case for zoena and said that she does have a case then that would be because (I think) they've seen all the details.
I think my DW told me once that different clothes firms sometimes have different ideas about what constitutes the sizes.0
